As much as I hate telemarketing calls, I have to agree with this judge. Ditto. The FTC has no business telling business' who they can and can't call.

The biggest problem I had with the idea was my name and telephone number ending up in another big government database. I know it's already there, but I am not going to VOLUNTARILY put it in another one.

Telemarketers are a pain in the ass. I could see this same logic here to be used in proving that downloading files such as MP3's is also none of the Government's business. It would not be tough to convince me, I already think that!

The FTC has no business telling business' who they can and can't call. The FTC is not stopping tele-marketers from calling anyone.
The FTC is giving me a tool so I can choose who uses my phone and the phone service that I pay for.

The FTC is NOT telling anything. The INDIVIDUALS who put their names on the list are telling the businesses that they do not want to be called.
This is actually a service to the businesses, who do not waste time and money on people who do not want to hear from them.

From what I can see, it's a simple bureaucratic SNAFU. The morons in Congress gave authorization to one alphabet agency (the FCC), but gave the funding to a different agency (the FTC). The judge really had no option other than to rule that the idiots in Congress screwed up.
Good grief, are we governed by a bunch of inept and confused simpletons or what?
