Yes. And that's part of why I expect the Supreme Court to throw out this Ninth Circuit decision.

Cooter--thanks for posting that article from the CA constitution.
Billybob---I sure hope you are right. This is beyond belief.
These sort of shenanigans set ominous precedents. What in the heck is in store for us in the upcoming Presidential election??

What we have here is a Liberal Lifetime Appointed Federal Judiciary
COUP!!! The PEOPLE don't matter one whit as already decided by a CA Judge that would not stop the Recall that the CA PEOPLE had decided should proceed on a timely basis.
Justice delayed is justice DENIED!!!
The 10 Commandments AND the 10 Amendments, especially THE 10TH AMENDMENT IS DEAD!!!

SCOTUS will wash their hands of this like they did in NJ when Toricelli dropped out and the dems plugged in Lautenberg.
Seeing how they ruled on Alabama's 10 Commandments, Michigan U's affirmative action policies and the sodomy law in TX, we were damn lucky in 2000 that they stopped the dems from stealing the presidential election.
The f_cking bastards have stacked the courts with Clinton lovers to circumvent the will of the people!

Could the Secrtetary of State offer a remedy which would not "violate" equal protection, but still keep the election date of October 7? In order to make things equal for every voter in California, consider switching to hand-counted, paper ballots for everyone?

It seems like they could toss the ACLU case on "ripeness" grounds.
