After releasing commercials proclaiming profound competence and unsurpassed knowledge of government, candidate MadClintock managed to shut himself out of appearing in the recall election voter guide. In the fine tradition of lifetimer statesman Al Gore, lifetimer pol MadClintock quickly filed a lawsuit and managed to hit a wall in that process as well.

McClintock's lawyer, Richard Ackerman, believes Secretary of State Kevin Shelley, a Democrat who opposes the recall of Gov. Gray Davis, is taking advantage of the opportunity to put a wrench in the senator's campaign.

I think you need to read the article you posted.

THis has nothing to do with the liberal Algore, or even the liberal RINO Arnold Schwarzenegger. This has to do with a First Amendment Right found in the US Bill of Rights.

From what it says, it appears that the Democratic Party Secretary of State is skirting the issue and not giving proper accommadations to Tom McClintock's First Amendment Rights, guaranteed by the Bill of Rights. The oversight or monor mistake that McClintock's camp made was immediately corrected, but the Democrats controlling California are still unwilling to handle this in a fair and honest manner.

FreeRepublic supports everyone's First Amendment Rights and so should you.

From reading the article, it appears that McClintock's lawyers screwed up by failing to timely introduce evidence that he amended his form prior to the deadline. Yikes.

Wow...that's incredible. Arnold has had some silly staff goof-ups too (not this bad, but just sloppy). What is it with the Republican's staff work down there???? I see a job in the making...

You're a mean-spirited RINO! Obviously, 25 years of experience in running for office was not enough for McClintock to know how to fill out the paperwork. Shame on you!

When McClintock discovered the consequences of his choice, he amended his form and refiled it one day before the Aug. 9 deadline.

In other words, when McClintock realized his donations would be under the limit anyhow, he decided he better go ahead and check the box so he can be included in the voter guide book.

What would be really interesting is to see what date he filed the first form. He waited until the very last day to file the amendment. Also, once you file, can yoy file an amendment? Should you be able to file an amendment? Allowing such amendments leaves open this problem:

1). Candidate beleives he will get tons of donations, putting him over the limit to be included in the voter guide book.
2). On the last day he finds out donations have not come in as expected so he says, wow, I better get in that voter guide book. Quick, file an amendment.
3). If you allow the filing of the amendment, you violate the intent of the law and the check box on the form - you agree to limit your spending to help make it a fair race. In exchange, you get to be in the voter guide book. If you don't agree, go buy your media elsewhere. You should not be able to have it both ways by filing one way then filing a different when you see things did not go as you planned.

What am I missing here? McClintock should not be so careless when filing forms. This is not a simple matter of forgetting to dot an i or cross a t. I say, tough luck. Be more careful next time. It was an important question on a form you took lightly.

I've been an Arnold-defender in the interests of his fiscal values and also the simple fact that Democrats don't stop terrorist attacks... Republicans do.

I think all Republicans should get upset, however, when garbage political manipulation hurts one of our candidates. You can bet that if this happened to Cruz, he'd be in that voter guide. This kind of sleazy power at the top is one of the reasons we have to push so hard to wrest control of the state away from the RATS.
