Flooded with 27,000 e-mails urging him to intervene, Florida Gov. Jeb Bush has asked a judge to delay setting a date for removal of a feeding tube sustaining the life of a brain-disabled woman, Terri Schindler-Schiavo.

In a letter, Bush asked Pinellas-Pasco Circuit Judge George W. Greer yesterday to keep her alive until a court-appointed guardian can "independently investigate the circumstances of this case and provide the court with an unbiased view that considers the best interests of Mrs. Schiavo."

On Friday, the Florida Supreme Court refused to intervene in the case, clearing the way for a Sept. 11 hearing in which Greer would set a date for removal of the feeding tube.

Bush said, according to a copy of the letter obtained by WND, he normally would not write a judge concerning a pending legal proceeding but noted the 27 e-mails his office received "reflecting understandable concern for the well being" of Schindler-Schiavo.

"This case represents the disturbing result of a severe family disagreement in extremely trying circumstances," Bush said. "Emotions are high, accusations abound, and at the heart of this public and private maelstrom is a young woman incapable of speaking for herself."

As WorldNetDaily reported, Terri's parents, Bob and Mary Schindler of Gulf Port, Fla., have been locked in a decade-long legal battle with their son-in-law over the care and custody of their daughter, who suffered massive brain damage when she collapsed at her home 13 years ago under unexplained circumstances at the age of 26.

The bitter dispute over Terri's lack of care became a major euthanasia battle five years ago when her husband Michael Schiavo petitioned the court for permission to have her feeding tube removed, claiming she is in a persistent vegetative state and would not want to be kept alive "artificially." The Schindlers and a number of doctors and therapists believe she could be rehabilitated, but the courts have consistently sided with Schiavo and his lawyer, right-to-die advocate George Felos.

Schindler-Schiavo was hospitalized Sunday for the second time in less than two weeks, CNSNews.com reported yesterday.

"The parents don't know what's going on, but she appears to be in critical condition," family spokeswoman Pamela Hennessy told the news service. "It appears to be pretty serious."

"The Governor grants a reprieve."

Asking dishonorable Judge Greer to reconsider his cruel and unusual 56 to 84 day death sentence ( it usually takes 8 to 12 weeks for a human being to die of starvation, however infection usually hastens death ) is no reprieve.

The president's brother has not intervened.

Governor Bush's logical and reasonable request of Judge Greer provides no fodder for criticism by the 'pro-death' crowd. I hope for the sake of Terri and her family a guardian who will evaluate the situation objectively will be appointed.

Even without hearing the man's voice but being totally aware of his behavior before, during and after Terri's collapse, it is obvious to me who should be the actual one to die.

I heard most of that Schnitt interview.
I tried to give him the benefit of a doubt, since I am predisposed to side with the Schindlers, but I too, thought he sounded "creepy". ..........


Like I said, I knew next to nothing about it. Had heard the name Schiavo but knew little. But her husband's voice on the talk show was way too measured and dispassionate. Clinical about his wife's upcoming planned death. Evading whether he would allow Shnitt to visit the wife to see her condition. When I hit Free Republic it all fell into place. That this ghoul has indecent reasons for wanting to terminate her life.

Can Jeb Bush declare the impending death of this unfortunate creature a "death sentence" and pardon her? Her crime: choosing the wrong husband and getting stuck with the wrong judges? Maybe there is nothing legally that Bush can do here. FL may be one of those states with an institutionally weak governorship.

For sure, this judge will ignore Bush's request.

I understand after reading the judge's response that he does not believe that the Governor has any power to change the circumstances.

But, the Governor did attempt to intervene.

(His family is not relevant, is it?)

Baby's on the way and he lives with the fiance while planning Terri's demise. He was complaining on tv that this has been dragging on for five years. Well, yeah, five years of Terri's life of medical neglect and false imprisonment by her husband. Jeb Bush was right. A guardian ad litem would have been the only right move to make but Judge Greer "put Jeb's letter in the file."

We need to make sure the national media keeps hearing from us.

The state just voted to preserve Cypress Gardens but Terri is going to be killed. That is unconscionable to care more about tourist attractions than a disabled woman who is for all purposes, ALONE and being condemned to death in Pinellas County, Florida, the 6th Judicial Circuit of the State of Florida. Her sentence will be handed down by J. Greer on September 11, 2003.

The fate of this poor creature is more than I can bear. I honestly don't know if I can read any more Schindler-Schiavo posts. I am more disappointed in the American people and their system of justice than at any other time in my life. Well, "disappointed" is a mild term to describe my outrage. Yet, I am totally UNSURPRISED.

I've compiled portions of the Florida Constitution having a bearing on the available (limited) legal options Governor Bush can employ to assist Terri, with inserted comment .

It must now be obvious to even those who chose not to see that the dishonorable Judge Greer is determined to provide any and every assistance to bring about the very slow and painful death of Terri Schindler-Schiavo. He has put the governor on notice that he will not be moved by concerns expressed by tens of thousands of American Citizens from every state in the union.

Displaying a stone cold arrogance last visited by humanity through the butchers Hitler employed to carry out 'the final solution', Greer mockingly commented he 'filed' the Bush plea for reasonableness.

State of Florida Constitution
Article III, Section 3, (c)(1)
(c) SPECIAL SESSIONS.

(1) The governor, by proclamation stating the purpose, may convene the legislature in special session during which only such legislative business may be transacted as is within the purview of the proclamation, or of a communication from the governor, or is introduced by consent of two-thirds of the membership of each house.

Comment: An immediate call of the Legislature to enact law to severely restrict and specify the circumstances within which any Florida court may order the death of an aged or infirmed Citizen ( euthanasia ) - using the wreakless and barbaric abuse of court authority applied in the matter of Terri Schindler-Schiavo as their reference.

SECTION 8. Executive approval and veto.--
(a) Every bill passed by the legislature shall be presented to the governor for approval and shall become a law if the governor approves and signs it, or fails to veto it within seven consecutive days after presentation.

SECTION 17. Impeachment.--
(a) The governor, lieutenant governor, members of the cabinet, justices of the supreme court, judges of district courts of appeal, judges of circuit courts, and judges of county courts shall be liable to impeachment for misdemeanor in office. The house of representatives by two-thirds vote shall have the power to impeach an officer. ...."

Comment: It is wishful thinking to hope action can be taken against der Bezirksrichter Greer. Unless he is over seventy years (age limitation), or he's committed a misdemeanor, we're paddling without oars.

ARTICLE IV - EXECUTIVE

SECTION 8. Clemency.--
(a) Except in cases of treason and in cases where impeachment results in conviction, the governor may, by executive order filed with the custodian of state records, suspend collection of fines and forfeitures, grant reprieves not exceeding sixty days and, with the approval of two members of the cabinet, grant full or conditional pardons, restore civil rights, commute punishment, and remit fines and forfeitures for offenses. ...."

Comment: Summer, granting a reprieve is a temporary action a governor can do independent of the other two branches of government. Governor Bush sent a personal letter to the judge; having as much weight as a letter you would / have already sent to that despicable misrepresentation of American justice.

ARTICLE V - JUDICIARY

SECTION 5. Circuit courts.--
(a) ORGANIZATION.--There shall be a circuit court serving each judicial circuit.
(b) JURISDICTION.--The circuit courts shall have original jurisdiction not vested in the county courts, and jurisdiction of appeals when provided by general law. They shall have the power to issue writs of mandamus, quo warranto, certiorari, prohibition and habeas corpus, and all writs necessary or proper to the complete exercise of their jurisdiction. Jurisdiction of the circuit court shall be uniform throughout the state. They shall have the power of direct review of administrative action prescribed by general law.

Comment: The usual pap for a functioning court.

SECTION 12. Discipline; removal and retirement.--
(a) JUDICIAL QUALIFICATIONS COMMISSION.--A judicial qualifications commission is created.
(1) There shall be a judicial qualifications commission vested with jurisdiction to investigate and recommend to the Supreme Court of Florida the removal from office of any justice or judge whose conduct, during term of office or otherwise occurring on or after November 1, 1966, (without regard to the effective date of this section) demonstrates a present unfitness to hold office, and to investigate and recommend the discipline of a justice or judge whose conduct, during term of office or otherwise occurring on or after November 1, 1966 (without regard to the effective date of this section), warrants such discipline. For purposes of this section, discipline is defined as any or all of the following: reprimand, fine, suspension with or without pay, or lawyer discipline....."

Comment: Lawyer buzz that is only implemented if all of the following prerequisites are met: the crime must have been attempted or completed by one of their own at high-noon on a highly traveled roadway on a Tuesday and he or she has publicly acknowledged he or she is the perpetrator in writing witnessed by a notary public in good standing within fifteen minutes of the commission of a crime.

ARTICLE VI - SUFFRAGE AND ELECTIONS

SECTION 4. Disqualifications.--
(a) No person convicted of a felony, or adjudicated in this or any other state to be mentally incompetent, shall be qualified to vote or hold office until restoration of civil rights or removal of disability.

Comment: I would suggest that Terri's friends and family elect her dog catcher , or some such thing. In the alternative, Governor Bush appoint her to one of the bazillion commissions in Florida - forcing her intended killers into an open court evidentiary battle over Terri's cognitive abilities.
