Effort to recall governor qualifies for California ballot: Gray Davis Will Face Recall Election

Gov. Gray Davis became the nation's first governor in 82 years to face a recall election, as California's secretary of state announced Wednesday that a Republican-led campaign once discounted as improbable had qualified for the ballot.

Davis, a career Democratic politician who was elected in a landslide in 1998 before his popularity plunged amid California's energy crisis and budget deficit, must face the electorate in 60 to 80 days, according to state law.

Does anyone know if McClintock could resurrect Prop187 by appealing to the US Supreme Court?

The short answer is no.

The process would go as follows: First the California Attorney General (not the governor) would have to convince the California Supreme Court that Davis acted outside the scope of his authority when Davis met with a small number of special interest groups to arbitrate the original appeal to the 9th Circuit.

If the California Supreme Court agreeed that Davis acted outside his authority then the AG would have to petition the 9th Circuit to set aside the arbitration results and reinstate the original appeal.

If California lost it's appeal in the 9th Circuit then it could seek relief from the SCOTUS.

The latest Public statement by Lt Gov Busted-monte is that it is up to him to ONLY SET THE DATE. That the lawyers would settle the other issues.

Damn, the AG will never agree to even begin the process.

What about a new Prop 187 Referundum? Who has the authority to call for a new Referendum?

There's got to be SOME way to cut off social services to the worthless mooching Illegals - Maybe some sort of Executive order requiring valid ID to receive most forms of state services?

Yes. I heard Rirodan say (or read it) a month or so ago that either he or Schwarzenegger would run -- and then added he is isn't running. He indicated Arnold was going to run.

Shelley will accept filing petitions for candidates, and the print their names on the ballot. I think it is *Cruz* who will be required to take the affirmative step of seeking court relief, not the recall backers...

Well .. We have't dumped him yet. We have accomplished getting the recall on the ballot .. now we have to get people out to vote in the election. Davis could still end up winning if there are not enough people saying they don't want him.

First part of the ballot - DO YOU WANT TO RECALL. If there are NOT ENOUGH yes votes, he could end up staying.

Next part of ballot - (if you said yes) WHO DO YOU WANT TO REPLACE HIM

If Davis is actually recalled (enough yes votes) - and another dem is willing to run - they could actually win if the GOP has so many candidates that there are not enough votes for one person.

I'll be first in line at the voting booth. Guarantee you that.

I hope Ah-nold runs but if not, I'll certainly find someone to vote for that has an "R" next to their name.

Bad news for Davis is that because it's not timed to the Democratic Primary in March, now, it's far more likely that those who want him gone will turn out to vote.

Looks like Gray is outta there...

Thanks for the info. Interesting. The lieutenant governor is way over his head here. I suspect there are many cruel jokes being made about him at his expense in Sacto bars that the politicos frequent as we speak.

Yes but, remember that there will be FAR more people showing up to say "Yes" to Part I of the ballot than to vote to keep Davis.

The problem is that the Lt. Gov says he will not call for the ballot to have other candidates, and if Davis is recalled, he will be the governor! It appears this may be legal. Good Grief!

Actually not.

The Secretary of State, Kevin Shelly, is the chief elections officer of the state and at his press conference this evening he said he would, unless advised otherwise by the state supreme court, accept papers from all candidates and print two questions on the ballot. The ballot would contain the recall question and if recalled a list of candidates to replace Davis. Shelly further advised that he has informed Bustamante of his decision.

A reminder that Shelly, not Bustamante, prints the ballots.

But, all kidding aside, I am a bit concerned about some of the noises he's making, and wonder if anything can be done if he chooses to try a "palace coup."

Riordan is not running.

The running are Simon, McClintock and Issa. However, just one of them needs to run - and I heard they were planning to meet and decide which one.

Hugh Hewitt says Ahhnold has told his 'people' he won't run. Rumor is he might take on Boxer for Senate.

A much better place for him in theory--if he doesn't vote with RATS on judicial nominations.
