So what does their preamble say?

Guess they should change "formally" to "formerly" if they're going to pander to Islam.

Why didn't the EU just copy Communist Manifesto for their constitution? It would've saved all the hard work spent on this document and said virtually the same thing.

I don't think God is in the U.S. Constitution either. God is in the soul of America. Putting God into the supreme law of the land will only get you places like Afghanistan. So I'm really sorta glad he isn't in it.

Regulating into the sunset

THE EU’s draft constitution is now available virtually in its entirety, complete with helpful annotations by Valery Giscard d’Estaing and his team. Like the Maastricht treaty, it is a tediously repetitive document. Like the Maastricht treaty, it is essential reading for business people, who have learnt the hard way to see through the British political delusion that EU treaties do not mean what they say.

In the political knockabout, the Opposition naturally focuses on the new powers being assembled collectively, particularly on foreign affairs and defence. Leaving that aside, Peter Hain, our man on the drafting commission, insists that it has really been just a tidying up exercise to cope with enlargement.

For business, however, that is just the problem. By limiting changes and leaving all the main relationships intact, the constitution will rule out any fundamental reform of the way the Union works for many years ahead.

One small clause towards the end of the document illustrates the difficulty. The draft contained a modest suggestion that European Commission regulations, delegated to Brussels by framework laws, might be given time limits so that the silly, needless or unreasonably costly ones that make the headlines can be weeded out after a few years without too much fuss.

Only regulations that were still needed would be kept and reasserted. This was a small attempt to introduce sunset clauses, into the delegated regulations made by bureaucrats. What we really need is for sunset clauses to be built in to all EU directives so that they automatically lapse after a period of up to 20 years. They can then be recast to meet the new needs of the time. Far from this happening, however, a flood of objections has caused even the idea of sunset clauses in bureaucratic regulations to be dropped. It would, the objectors insisted, introduce an unwelcome degree of uncertainty.

The difficulty of changing European laws once they are made is one of the EU’s worst features for business, where continuous change needs a flexible legislative background. So far, most of EU law is actually about commercial matters. Yet it seems harder to update than the US Constitution. Trying to change company law in the UK is laborious enough, as reformers are just now discovering. In the EU, it seems virtually impossible, not least because only the Commission may propose legislation to the Council and to the European Parliament.

Some reforms in accounting, for instance, could not be made because they fell foul of an obsolete EU Directive. Only a new Commission initiative mandating International Accounting Standards has accidentally saved the day.

The draft constitution also enshrines the continental social model in ways that are now plainly out of kilter with the free market economies. The sort of reforms that Gordon Brown, among many others, wants to see in Germany, Italy and France, will be made that much harder. The constitution insists on incorporating the old social model of collective representation of business and trade unions into its basic laws as well as tripartite advisory councils. Social charters and human rights legislation, which has become a bane of businesses big and small, will also be set in constitutional aspic.

A generation of British ministers has called for reform in the way the EU operates to increase speed of action, improve efficiency, save waste, dilute agricultural and trade protectionism and generally make our Union more responsive to our needs. All that can now be forgotten.

Of course God is kept out of the EU. Europe is metric, for cryin' out loud. If God had meant for us to use metric, Jesus would have had only ten disciples.
