To convict Peterson of murdering his unborn son, prosecutors would have to prove either that he intended to kill the fetus or knew that it would die as a result of Laci Peterson's death.
Let's see:
Killing the pregnant mother,
Partially dismembering the pregnant mother,
Wrapping the pregnant mother in plastic sheeting,
Dropping the pregnant mother into a body of water and weighting the body down with concrete.
Scott surely wouldn't expect the baby to be born in Cleveland.
If the mother's death was truly accidental, Scott probably would have called 911, got emergency help, and the baby could have been delivered and lived.

I can't buy the idea some people have that this murder was accidential. I firmly believe that this was a pre-conceived, plotted homicide. This guy has never shown any type of emotion. He's never once shown any real concern for her loss or the baby's. His demeanor is not that of someone who accidentally caused the death of their wife and child. If anything, he's appeared to be pretty relieved to be rid of them both. I didn't even see any emotion or concern on his face in the brief video of him at the sheriff's department. It's as if this guy has a stone, cold heart. No, this wasn't an accident, this was murder caused by an extremely evil person.
