The kidnapping still stands since they were married that night, although ater the prisoners in jail get through with the Mitchells I dont think they would want to live anymore.
Inmates don't take kindly to pedophile kidnappers.

I've done some work in several prisons and the word on the inside is that pedophiles/child molesters are considered to be the lowest lifeform in prison.
Mitchell will be living his worst nightmare, but there will be no escape from it.

Perhaps not. A trusting warden may well take the Mitchells in as live-in help..... 8~(
