The President should summon 26 Democrats to the White House.

While they are engaged in Discussion, The Republicans should motion to amend the cloture rule. They will have more that 2/3 of Senators Present and Voting.

The Senators are paying attention to the big city newspapers. This Miami Herald editorial is excellent, and the "e-mail (to a friend)" link at the bottem will allow you to send off the editorial to multiple Senators. Just cut and paste the following list to the "To:" box.

The Rule change Requires 2/3 of those PRESENT and VOTING.


So, if a 24/7 session plays out with one or two dums holding the floor, while the (r)'s keep all 51, to maintain a quorum, at a time when it will not be possible for the dems to rush 24 senators in, you motion to amend the cloture rule....And Send the SAA to retrieve Dasshole and Hillary!ous from their beds, to witness it.


Anyway, even if they do rush 20 odd in, and defeat the motion, you will have scared the crap out of them and they will be forced to man the parapet as well.

While I think there is definitly a dichotomy
between the Constitution and the Senate rules,
I do not think the R's want to be seen as going
to the Scotus to solve the problem right now.
The Dems would really spin this!!

Right now the plan is for more editorials, more talk show appearances, more embarrassment for those who voted "N".

IMO, I think by the third vote, Estrada will be appointed. Infact, it wouldn't surprise me if there weren't enough "Yea" after the second.

But, was just wondering if the SCOTUS has ever ruled on procedural issues in either the House or the Senate?

Agreed. The best thing to do it to fight this battle, and let at least one of two things happen:

1. Estrada is confirmed.
2. The Dems suffer horrific damage among Hispanics.

In the next Congress, we change the rules.

I hate to telegraph my ignorance, but..

On his show (Tuesday?), Rush Limbaugh said that the dems have never used the term "filibuster". If what they are doing is not a filibuster (and is not going 24/7 as I was taught a filibuster should), how is it that 60 votes are needed to break what is not "really" happening?

If the dems are denying it is a filibuster, then wouldn't that mean a simple majority vote would still suffice? I've been reading this thread for awhile, and I have not seen it brought up.

This whole thing seems very fishy to me. Is anyone following the rules in the Senate at all?

see #643, and Feinstein at least has admitted its a filibuster, in any case now it is clearly a filibuster with a failed cloture vote, we just are not going 24/7 yet, reserving that oprion for a later time if needed.

Thanks. I read the thread #643 refers to, but figured that even though the word filibuster was used it was only for lack of a better term to describe the dems actions.

I'm getting pretty tired of the foot-draggin' going on with the Republicans(ie. Frist) He seems to need some back-bone and make those anti-hispanic Senators go 24/7.

I haven't had time to read the full thread, but seems we are all thinking of the USSC. I was thinking after the vote this morning that it took 37 days for the counting to end and Bush was elected the clear winner. Nothing has come easy for this president, but he's gotten everything he's asked for.

My question, have we even really begun to fight until we've gone through a legitimate filibuster? The more this goes on in this fashion it will embolden the DNC to cause more disturbances concerning the judiciary.

The Republicans must take this fight to another level, not about Estrada being a Hispanic or his disabilities and his ability to rise above them. I believe they must go to what's really at stake. Schumer laid it out today in openly making the connection of environmentalists, the Commerce Clause (which has been environmentalists personal weapon of choice), and any of Bush's nominees being strict constructionists, conservative ideologues.

Removing the dems next base has to be the goal or we will be here until election 2004, or Bush do a recess appointment. The President didn't say how it will happen just that he'll be by Estrada's side until he's confirmed.
