That's fine if he votes no. But will he vote to ALLOW a vote. That is now the question.
Personally, I have NOT urged my 'bad' Senator(Wyden, OR)to vote for Estrada's confirmation. But I am ALL over him to at least ALLOW the vote to occur.

My definition of advise and consent is the discussion in the Senate Judiciaty Committee.
It does not state the entire Senate has to be a part of the advise and consent for judges.
Committee should suffice and then the whole Senate will vote. If they don't like this, then we suggest they appoint Senators to the Committee they have more faith in.

Because they need unanimous consent to get the vote, and even though they have the votes to confirm Estrada, every time Hatch or Frist call for a vote, one Rat senator objects, so the debate continues.Citizen thanks for directing me to Post #361. That helped me to understand.
Miss Marple thanks for your explanation also. Hopefully I can keep this in mind and not get all confused again. If the tactics change please let me know what they are. ;-)

I think there were also people here on FR who were confused about that. Could that mistake have been a lot of the reason for people's opposing having a cloture vote?

What struck me about Rush today is that it evidently took him until now to realize that a cloture vote didn't mean the end of the Estrada nomination.I think that is the problem with the filibuster. It is hard to see how it plays out. It is really a huge game of "chicken". Rush is just like us in that we are in uncharted waters, and Gulf War 2 is about to begin.
So many things can affect the results including illness, external issues, as well as resolve.
I hope this Alamo story is leading to a discussion of the GOP fighting to hold against a filibuster...

Glad you noticed the same thing! That didn't give me a lot of confidence in the fact that the people around him didn't even bother to understand a filibuster and cloture vote and here he was attacking Republicans on not invoking cloture when a filibuster had not been declared.
Seems Rush and Major Garrett were originally on the same page except Rush admitted he didn't understand -- still waiting for Fox to admit their mistake.

The question is whether or not he will permit a vote.

I think you are right -- they had no idea that cloture vote was not the end of the filibuster. My reason for not wanting a cloture vote at the beginning was that it would set a bad precedent that could require 60 votes for confirmation of judges which is against the Constitution. I am past that since they are not giving up! Let them (RATs) pay for this in the end!
I am a "win at any cost" person and giving up this nomination is not an option. Just keep putting the RATs on record as voting against an Hispanic judge for the Appeals Court vote after vote. The moron that called that said this was great strategy on the part of the RATs can then eat his words!
Did you hear the Hispanic that called in? He was livid at the RATs and wanted every Hispanic to switch parties. Wish Rush would have allowed him to keep talking and talking!
