Idiot GOP Senate Set to Shaft Estrada?
rushlimbaugh ^ | 2/28/2003 | rushlimbaugh

I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.

Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.

Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.

These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!

These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

Listen to Rush...

That must be one messed up home though. How the two of them can stand the sight of each other is beyond me? I never believed that opposites attract when the opposites are both very opinionated and egocentric.

Isn't it odd that all of us misinterpreted what you said? I think not.

Face it, TLB, you're so discredited nobody expects you to post the truth anymore; we all know every article you post is aimed at the GOP and Bush.

Thank goodness know better than you.

As for this:

Can't wait for the Rush show on Monday

I'm sure you can't; you need some fresh material to to misinterpret. That's the problem with having no principles; you're always having to wait for somebody to tell you what you think.

OK .. I tried to read .. and I can't read any more .. I just can't ... forgive me for I am weak

As for the GOP .. IMO they have not given up on Estrada .. as for the Fox report of them saying so .. I don't believe it .. as for Rush .. I don't care what he says .. as for Todd, since he takes credit for everything and has "a gift" can I blame him for the 25 inches of snow I got 2 weeks ago?

Well, OK. I'll give you a hint.

Regarding those who suffer from Irrational Stubbornness:

"Once they make a decision, it gets tied up with ego and they can become irrationally committed to it. They anticipate feeling worse if they switch and lose than if they stick and lose.

Their brains are wired in such a way that encourages them to stay with their choices, no matter how poorly informed or insignificant they are. They'd rather feel right than reconsider."

I was talking about two different subjects with the 'gifter' in the post. One was about his contention that a cloture vote would change/amend the constitution... My question to him concerned what about pre 1917 when cloture was adopted then one or more Senators could stop any legislation in the senate and cloture didn't exist. Now 60 senators can halt debate and force a vote.... back then no such thing existed thus one or more senators could control... 41 is the number needed today.

Second, senators appointed by states again would be at the whim of the ruling legislatures/Govs. in each state. So where you have democratic controlled states look for them to appt democrat senators and vice versa for the Republican controlled states. Would we be any better off? I don't know but maybe we would. True senators wouldn't be on the take for money from the many interest groups. So from that standpoint they would be trying to curry favor from their state governing bodies. I just don't think it will happen, but in all honesty I'd like to see it tried again.

TLBSHOW..... still waiting for answers... crickets chirping... but from you that is the usual.. all cut/paste and no action.

we have discussed what I did and did not mean!

Only after someone told you what you meant..... correct? You never came on the thread and so stated it was Norquist that you were talking about until after someone else made the statement... Isn't that correct? If not maybe you can provide the statement where you said you were talking about Norquist prior to the other poster telling you who you were talking about. You have everything else bookmarked....

I agree on that point. What I don't think would happen is the tight national coalitions that we see today that keep the Democrat Senators in such tight lockstep on the bills/issues before it. I don't know how a Senator appointed at the whim of the CA legislature would support the warroom efforts of a Senator from NY. I could be wrong, though.
