Idiot GOP Senate Set to Shaft Estrada?

I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.

Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.

Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.

These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!

These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

The original intent of the Framers was not the use of recess
appointments as a political tool. The Congress only met for one session a year and it took wks to get there. Granting a recess appointment is not without political peril!

Yes I am woody, I'm saying the Constitutional mandate you and I have to a speedy trial by jury, and a review by a higher court is of primary import. We need Judges to fill Federal benches to attack unacceptable backlogs and their Unconstitutional usurpation of our legal system.
The Senate RATS have no intent to fulfill their obligation to fair and expedient advice and consent role to Executive appointments.

Bush is thus obligated .... TO US ... to fill open Court Judgeships in any way that is legal, ethical and in the best interest of our ONLY avenue to guard against the abuses of State and neighbor. Force and fraud.

Screw the RATS, they're the enemy. Not loyal opposition. Enemy.

And, if any Bush executive decree is deemed so abusive, so offensive and so intolerable to the American citizenry ... he's gotta win a vote of that citizenry in November 2004. Every judge he appoints will be subject to new nomination, review, advice and consent in 2005.
There's a very clear and direct referendum that will judge whether a recess appointment option is acceptable or unacceptable to our neighbors and countrymates. I like our odds ... EVERYONE understands the bullshit of red tape and delayed and denied justice.

Rush said Hatch called him and said Fox's story was wrong.

Hugh Hewitt has said he would be willing to take such a temporary recess appointment. I suspect many right-wing lawyers would. Such people are likely to have a lot of money saved.

So what does that response have to do with the price of tea in China?

Can you answer the question about which is better and why.... Post 1917 cloture with 41 Senators needed to stop legislation or pre 1917......

Again I'll also asked you how many States are governed by a Democrat Gov., Senate, House. How would that impact the make up of the Senate? Don't you think those controlled by Democrats will appt democrats?

You want to try those questions on for size.... And don't go with the cut/paste crap. Give me your own answer not someone else's.

Here is the last paragraph of the National Review article that headed the original thread that was already in progess (hours before Rush's program began) when fretting over the Fox article was posted, and then it was noted that Rush was under a false assumption due to relying on the Fox article:

Meanwhile, the Democratic filibuster goes on. Sources say the Republican leadership has still made no decision on whether or when to call for a vote to cut off debate and force an up-or-down vote on the nomination. At the moment, Republicans, who have all 51 of their own votes plus four Democrats, would fall five votes short of the 60 needed to cut off debate. But Republicans believe they are making progress and that the filibuster is beginning to take a political toll on moderate Democrats who are so far supporting the filibuster. Thus, the talking will continue. "We are on this next week," one Republican says. "We're committed to it."

As I have stated several times now, clearly the Republicans have a plan and are saving going 24/7 as a last resort in order to take away the dems' bogus excuses for not wanting a vote away, one by one.

It is very clear the Republicans were not caving.

and we have gone over that time and again Howlin. Like you I have opinions on things and sometimes I agree with Bush and other times I do not. I am not a person that will just say anything to win a popular contest that goes on around here. I know darn well when I say something that is against the grain it will make me less popular in the eyes of some but I would be a hypocrite if I said things I did not beleive or things that would win me comments like this from you or others.

I just heard on Rush's show that Fox News Story about a cloture vote is false. Rush heard from Orrin Hatch's office for one thing about it. So don't believe all that you hear in the media about this Estrada nomination including Fox.
