They are rights of individuals, possessed equally by all. It is to secure these rights—the rights of man under the laws of nature and of nature's God—that governments are instituted, deriving their just powers from the consent of the governed.

The governed individuals must be just to have "just" consent.

Marcus Tullius Cicero (106-43 B.C.), the Roman Stoic philosopher, said this concerning the natural law:

There is in fact a true law--namely, right reason--which is in accordance with nature, applies to all men and is unchangeable and eternal. By its commands this law summons men to the performance of their duties; by its prohibitions it restrains them from doing wrong. Its commands and prohibitions always influence good men, but are without effect upon the bad. To invalidate this law by human legislation is never morally right, nor is it permissible ever to restrict its operation, and to annul it wholly is impossible. Neither the senate nor the people can absolve us from our obligation to obey this law, and it requires no Sextus Aelius to expound and interpret it. It will not lay down one rule at Rome and another at Athens, nor will it be one rule today and another tomorrow. But there will be one law, eternal and unchangeable, binding at all times upon all peoples; and there will be one common master and ruler of men, namely God, who is the author of this law, its interpreter and sponsor. The man who will abandon his better self, and in denying the true nature of man, will thereby suffer the severest of penalties, though he has escaped all other consequences which men call punishment. [W]e have no government armed with power capable of contending with human passions unbridled by morality and religion....Our constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other. Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports. In vain would that man claim the tribute of patriotism who should labor to subvert these great pillars of human happiness, these firmest props of the duties of man and citizens. The mere politician, equally with the pious man, ought to respect and to cherish them. A volume could not trace all their connexions with private and public felicity. Let it simply be asked, Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths, which are the instruments of investigation in Courts of Justice?

And let us with caution indulge the supposition that morality can be maintained without religion. Whatever may be conceded to the influence of refined education on minds of peculiar structure, reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle. It is substantially true, that virtue or morality is a necessary spring of popular government. The rule, indeed, extends with more or less force to every species of free government. Who, that is a sincere friend to it, can look with indifference upon attempts to shake the foundation of the fabric?
