He also said that blocking Estrada's nomination smacked of racism. Hatch snapped, "It is hypocritical. It is wrong. It is unfair. It is establishing a precedent that could hurt this country immeasurably. ... To do it against the first Hispanic nominated to the Circuit Court of Appeals for the District of Columbia is particularly reprehensible, especially since he has every qualification a person needs to fulfill this responsibility.

There were PLENTY of Clinton's nominees that SHOULD have been challenged and denied...

The news is providing cover for the Democrats pretty well. The co-workers I have asked were not aware that a filibuster had been in progress. Yahoo and MSNBC have it buried out of the headlines.

The filibuster is certainly a legitimate legislative tool for the Senate to use. But it is absolutely critical that vacant judicial slots be filled expediently. Given that the political divide in this country is very close to 50-50, if both parties decide to start filibustering every nominee they don't fully agree with politically, I believe it could eventually lead to nothing less than a Constitutional crisis. I don't believe this tactic should be resorted to unless a nominee has something that is so egregious in nature as to render them beyond the pale.
