A vacancy could open up in the U.S. Supreme Court soon

Feb. 17 issue: It's been nine years since the last vacancy opened up on the U.S. Supreme Court. That historically long drought could end this year with at least one resignation. Eager White House aides are stepping up preparation efforts, vetting candidates and contemplating a special media operation to deal with a potential confirmation battle.
Other observers think Bush could take another approach, appointing California Supreme Court Justice Janice Rogers Brown instead. Brown is a conservative African-American who's ruled against affirmative action and abortion rights. Her nomination would let Bush add the court's third woman and second African-American in one swoop. And White House lawyers have already interviewed her. Tom Goldstein, a Washington lawyer who argues cases before the court, believes Brown could even get the nod for chief justice. "An African-American female nominee is not going to be filibustered," he says. She doesn't have a record that will stop Democrats in their tracks. And after months of bitter Senate fights over nominations to lower courts, that could have an appeal all its own.

I hope Bush is able to nominate Judge Bork while he's in office. I'd love to see some of these wacko left cases come before a Supreme Court with Bork on board.

I read, with great interest, your contributions to this forum. I agree, and I am proud that we are on the correct side of the political arguments of the day.
After reading your artical on Judge Brown I did some internet search and found your analysis to be right on the money. She is hated by the left and she seems to be a constitutional scolar of solid reputation. Of course, that means nothing to the left. Judge Brown holds the Consitiution as the law of the land, whereas the left wants a 'living' document. Law doesn't 'live' we obey the law that is written. We also have the ability and the responsibility to change that law, if we see fit.
After reading the history and the decisions of Judge Brown I find her perfectly suited for the bench, and perfectly suited for a seat in the highest court in this land.
I would like to meet this lady and exchange ideas. This will never happen, but I believe she is an excellant candidate for a Supreme Court Justice.
Thanks again for pushing me to research Judge Brown. It was enlighting, and informative.

I am not above sin for this dastardly act. I permitted 3 of my children to be killed before their birth date. I did so by non-action. I regret that, and I will ask for the forgiveness of God for that. I don't know if He will forgive me, but I do know that, as long as I draw breath, it will not happen again. I believe in the pro-life aganda, and I will stand for that.
...and if she were a white Southern male with those views, she'd be as dead in the U.S. Senate as a ban on congressional pay raises.
I think it makes more sense to put her on the Ninth Circus first, before moving her up to SCOTUS. Consider her a "second term" project.
As for Chief Justice, I'd go for Thomas and/or Scalia. Try to put both of them in first. If the left borks them, so be it. Then nominate another strong conservative. The American people and the senators can only put up with so much borking before it gets old and people stop caring. Wear them down. And I'd love to see Thomas get a second shot and defending himself and I'd love to see Scalia defend himself to the intellectual midgets (uh, intellectual little people, in PC speak) on the left.

Written constitutions were never intended to be enumerations of inalienable rights. The US Constitution even says that explicitly.
This decision indicates that Brown would likely adopt the ridiculous militia tests that have been invented to disarm the people.
This woman would obviously uphold the power of Kalifornia to disarm me. She is totally unfit to be a Supreme Court justice.
The implication of her decision is that freedom of speech could be outlawed in Wyoming by a state constitution amendment. What dangerous nonsense.
