Thanks for the link.
The last paragraph made me chuckle:
Having failed to assemble a plausible case against him, Democrats are now arguing that this failure is itself grounds for his rejection -- because it stems from his own and the administration's discourteous refusal to arm Democrats with examples of the extremism that would justify their opposition. Such circular logic should not stall Mr. Estrada's nomination any longer. It certainly doesn't warrant further escalating a war that long ago got out of hand.

I suspect Daschle didn't make his scheduled announcement at 1:30 on Monday because the RATs couldn't come up with the votes for a filibuster. Hence the talk in this article about what the RATs will do if they don't have the votes.

The dems are only doing this as RETRIBUTION toward Estrada.
During the 2000 election aftermath, Estrada wrote one of the legal papers presented to the USSC in Bush v. Gore.
