(Sacramento) – Former State Assemblyman Howard Kaloogian announced today that he is leading an effort to recall Governor Gray Davis (D - California) from office.

The recall campaign was launched this morning with the unveiling of the website, www.RecallGrayDavis.com, which will serve as the online hub for collecting contributions to finance the recall effort, recruitment of volunteers, and organization of the signature gathering process.

Kaloogian To Lead Disaffected
of All Political Parties in Recall Drive

The preliminary stages of the recall effort will focus on raising funds and organizing a volunteer force in preparation to begin the signature-gathering process to qualify the recall. Kaloogian will be reaching out to leaders in every political party to build support for the recall across the political spectrum.

“I am starting this recall drive after determining that there must be a broad-based and multi-party effort that will have the credibility to qualify the recall for the ballot. As it stands right now, we need leadership to unite the various splinter recall efforts that have been sprouting up over the past several weeks,” Kaloogian declared.

Kaloogian, who served in the California State Legislature as a Republican Assemblyman for three two-year terms, continued by promising to “aggressively lead those who are disaffected in a sweeping recall effort that will send the message to politicians around the country: you WILL be held accountable for deceiving voters during your campaign.”

For the next several weeks the Recall Gray Davis effort will focus on organizing and recruiting the thousands of volunteers needed to collect the requisite 898,000 valid signatures to qualify the recall measure on the ballot.

Davis Malfeasance in Office and Lies to Californians
Far Exceed Standards for Recall

According to Kaloogian, the recall is predicated not just on the complete malfeasance of Gray Davis while in office, but also the recent revelations that he lied about the size and seriousness of the state’s budget crisis in order to secure re-election. Davis took an $8 billion surplus and turned it into the largest budget deficit for any state in American history – almost $35 billion by his own estimates. Massive increases in taxes – even a proposed Internet tax – cuts to fire and police protection and education are being proposed by Davis as ways to bail himself out of the mess he created.

In addition, criminal investigations and court testimony revealed that Davis was so consumed with fundraising, that he paid little attention to the challenges facing the state. On the day a crucial piece of legislation to address the energy crisis was before the legislature, Davis did not even work for the bill’s passage. Instead, he flew to Palm Springs for a golf fundraiser.

Kaloogian explained that while the recall process is not to be taken lightly, Gray Davis has left Californians with no other choice but to recall him before we see more job losses; cuts to education, police and fire; higher taxes; suffocating government regulations; and the exodus of companies and productive individuals out of the Golden State:

“The recall process is something that should be reserved for only the most serious cases of malfeasance in office. Unfortunately Gray Davis’ conduct far surpasses the standards necessary to justify a recall. It’s not a question of whether we should recall Gray Davis, it’s an issue of how long can we afford to wait – all the while watching California slide further into the abyss,” Kaloogian concluded.

Bustamante can run if he wants. So can anyone else. In California, the recall ballot has two questions: 1. Do you want to recall the current governor? and 2. If so, who would you like to be governor: pick from this list.

In other words, the Lt. Gobernador will not automatically become governor. Whoever wins the plurality will. And I don't see Cruz "I didn't mean to say the N-Word" Bustamante doing that in a recall election.

A funded, concerted effort should have no problem getting these signatures. The original Recall Davis effort mounted by the California Coalition for Immigration Reform and Voices of Citizens Together in 1999 got 470,000 signatures with a budget of just $70,000.

Even Shawn Steele and his merry band of screw-ups should be able to double that with the kind of dollars they have access to.

With this action, you will ignite the biggest tax revolt that California has seen since Prop 13.

So be it.

But before you do, I want to address the sophistries that form the foundation of this measure, so at least the record is clear.

The first we just heard is the notion that the legislature intended that the tax go up in bad economic times, and this bill therefore doesn't change existing law. Well, if existing law really did that, you wouldn't need this bill, would you?

The truth is that if this provision had been part of the original law, the car tax reductions could never have taken place even in the good times.

The provision they cite has been clearly understood and practiced by the state controller's office for the five years since that legislation was adopted.

Under that provision, there are only two circumstances that would trigger an increase. The first is gross incompetence by the Controller in failing to maintain sufficient funds to cover the anticipated obligations of the state. The other is if the state were closed out of the capital market. In the entire history of California, neither of these events has ever occurred.

This measure fundamentally changes existing law.

It redefines the general fund - in an unprecedented manner -- to remove from the calculation of fund balance any outstanding loans.

Even in good times, short-term loans are routinely made to the general fund - from both internal and external sources -- to even out the state's cash flow. That's what keeps the money in the general fund all year long to pay the state's obligations while revenues fluctuate month-to-month.

By deducting any outstanding loans from the general fund's condition, you have just guaranteed that the car tax will be tripled - even in good times -- because this is the condition of the general fund throughout much of the year - even in the good times.

So let there be no confusion: the effect of this measure is to automatically and permanently triple the car tax.

The second sophistry is that local governments will suffer without this bill. The truth is that in the five years since the car tax was reduced, local governments have not lost a penny of support. Indeed, the ONLY way local government support can be cut is by a vote of this legislature. And the budget committees of both houses have unanimously rejected any proposal to raid local government funds.

The third sophistry is that this measure only requires a majority vote. The Constitution is not ambiguous on this point: "any changes in state taxes enacted for the purpose of increasing revenues... whether by increased rates or changes in methods of computation must be imposed by an Act passed by not less than two thirds of all members elected to each of the two houses of the legislature."

So you are deliberately enacting an illegal tax by majority vote in direct and flagrant violation of the state constitution. So much for the rule of law.

The state's problems are not a shortage of revenue. AFTER the car tax was reduced and AFTER the dot-com collapse, and AFTER the state's revenues plunged, we're still taking in 28 percent more revenue than four years ago while the population and inflation combined have grown only 21 percent.

And AFTER the car tax was reduced, it is still the highest among the five largest states, and indeed is twice as high as the next runner-up.

You want to start a tax revolt? You're on. In the last three days, three thousand volunteers have logged on to my website and pledged 200,000 signatures toward a ballot measure - and that's just the result of a few radio interviews. If this response continues, I believe we'll have enough signatures to abolish the entire tax outright - which is what we should have done five years ago. And that's just the beginning of the tax revolt you are starting today.

So go ahead. Make my day.




Tom has started a petition process to outlaw the proposed license/fee via the referendum process. I went to his web site this past Saturday, and asked for enough petitions for 12 voters. Just by casual talking about it on Sunday and Monday, I can get 20 to 24 signatures in about one to two days with no real work. That includes a couple of former Davis supporters and a few moderate families who own two or more vehicles.

Many will start their own petition drive.

This is what scared Davis away from behind the curtain as this incredible tax/fee scheme was being advanced.

If the CA GOP is stupid, then so is the CA Dem party. This IS a bipartisan effort, with Pat Caddell, former pollster for Jimmy Carter, working on the other side of the political spectrum. It isn't just GOP sour grapes.

I just read a thread that talked about a former GOP state legislator spearheading this, so it's a GOP effort as far as I'm concerned. The goals of any anti-tax group or whatever that officially is going after this recall are the same generally as the GOP. The time to beat Davis was November 5, 2002.

Bustamante or Feinstein or any number of Democrats would replace Davis. This is an awful waste of time.

Focus on beating Boxer.

Do you really think your work is better spent trying to recall Davis and then run against an even stronger Democrat (Bustamante, Feinstein, and many others) than trying to beat Boxer? Who is going to beat these strong Democrats? Bill Simon?

That's my point. What does this gain you? A stronger Democrat who will be running for RE-ELECTION next time-- that's what. Davis is a bad governor who lost to a bad GOP nominee, but give it a rest. He won, we lost. Live to fight another day-- especially when the next battle against Boxer is quite winnable.

The Dems can afford to cleanse their party. They can replace Davis with a very strong Dem who will run for re-election in 2006.

I'm not saying it's sour grapes. It's just a bad use of time. The GOP lost everything last November. Focus on winning a statewide race-- any race. Start with Boxer's seat.

I was involved with the recall put on by Glenn Spencer and the "Voice of Citizens Together" Group, of which I was a member.

We worked our arses off, even compiling a list of gun stores and shooting ranges throughout the state who were willing to put the petitions in their places of business. We thought for sure we were going to be successful. We fell extremely short of the 1.3 million signatures that we needed. Why? Because the media would not talk about it! Period.

I admonished my own local paper during the recall because I hadn't seen anything about it and I considered it newsworthy. They stated they had posted a piece about it.....in an article that was so small you'd be lucky to have found it.

I wish his group luck, but Davis is probably better of like one poster said "sitting in his own filth" struggling through the next 3 years. Besides, who is a possible replacement at this late game? I enjoy reading, and listening, to citizens beat up this man every time I hear and see it. He's a filthy traitor and deserves whatever he gets. Thanks for the millions of illegals, Davis!
