A major plank in her plea to Securities chief Beverly Bassett was an audit from Frost & Company. Although the audit claimed that Madison Guaranty was solvent, it was hopelessly insolvent and losing millions of dollars of taxpayer money per month. Hillary's role in extending the life of Madison cost the taxpayers at least $30 million.
Madison was finally shut down, not by Arkansas (it was a state-chartered S&L) but by Washington. Now it was time for Hillary to have more fun. Much like a man in San Francisco may decide he doesn't like girls any more and switches sides, Hillary switched sides. She actually represented the FDIC in a lawsuit against Frost & Company. How could that be? Hillary and the Rose Law Firm were a major part of the problem with Madison.
Was what Hillary did unethical? Is Jesse Jackson a race baiting poverty pimp? Of course it was unethical. Hillary had an obligation to inform the FDIC that she represented McDougal and Madison before state regulators in 1985.
The Clintons are expert in the parsing of words. Here was an opportunity for Hillary to parse ethics. The FDIC business did not just fall in the Rose Law firm's lap. Vince Foster actually solicited the business a few days before the government took over Madison on March 2, 1989. He put the Rose representation of Madison in the present tense by saying that Rose does not represent any S&Ls at the time. He failed to mention the prior work.
Webb Hubbell was put in charge, and of course, Hillary added her considerable ethical talents. The government's claim against Madison's accounting firm was for $20 million--$10 million in damages and $10 million for punitive damages. Amazingly, Rose Law firm settled for only $1 million, only 5 percent of the claimed amount. That was even less than the policy for which the accounting firm was insured. The Rose lawyers received a hefty $400,000 in fees, while the government (you and I) received $600,000. That was 3 percent of the claim and 1 percent of the loss.
Oh, come on. Wasn't Hillary entitled to one little mistake? Well, this was not the first scam like this that she pulled. Lasater & Co. (Bill Clinton to L.D. Brown when Brown discovered that cocaine was being brought into Mena from Central America --"Don't worry about it; that's Lasater's deal") had been involved with the First American Savings and Loan in Oak Brook, Illinois, a Chicago suburb. Like Madison it had gone belly up. Lasater's firm was partially responsible because of unauthorized trades using the thrift's funds.
In 1987, when the S&L failed, the FDIC took it over and kept Rose on as their attorneys. One of the two lawyers chosen to sue Lasater's company was none other than Hillary Rodham Clinton. Hillary, of course, was the sister-in-law of Roger Clinton whose drug debts had been paid off by loans from Lasater. She was also the friend, political ally, and social buddy, recipient of entertainment, jet plane rides, and cash contributions to her husband's campaign, from the man who owned the company being sued.
Foster was the lead attorney, and Hillary signed on as No. 2. The lawsuit was for $3.3 million. At the time, Lasater was in jail for cocaine distribution. What was the outcome? $3.3 million for the government? No. Foster and Hillary settled the case for $200,000, much of it eaten up by their legal fees.
What did Hillary say? Come on. She, of course, had little to do with the case. In reality, she actually signed four official documents.
When the scorecard was checked, The Rose Law firm had been hired by the RTC in this type of case 22 times (as of the printing of the Professor Gross book). It earned the firm $1.27 million, part of which went into Hillary's pocket.
In 1988, Rose and its insurers paid a fine of $3 million to the FDIC regulators for a conflict of interest in connection with the failure of First South Savings and Loan, the largest loss to that date in the entire S&L debacle.
Were the crimes of Whitewater real? You bet. Were they very complicated? Absolutely. Would a jury in Washington, D.C. composed of dumbed down people ever convict Hillary? You know that answer. Ken Starr knew that answer. That's why she got off the hook. The dumbing down of America had worked in her favor.
I hope it is now clear to everyone why Hillary had to make sure no one saw those infamous billing records until after the statute of limitations had run.
