Section 100.00 Criminal solicitation in the fifth degree

A person is guilty of criminal solicitation in the fifth degree when, with intent that another person engage in conduct constituting a crime, he solicits, requests, commands, importunes or otherwise attempts to cause such other person to engage in such conduct.

Criminal solicitation in the fifth degree is a violation.

Section 235.05 Obscenity in the third degree

A person is guilty of obscenity in the third degree when, knowing its content and character, he:

1. Promotes, or possesses with intent to promote, any obscene material; or

2. Produces, presents or directs an obscene performance or participates in a portion thereof which is obscene or which contributes to its obscenity.

Obscenity in the third degree is a class A misdemeanor.

I agree about the mug shot NOT looking like a mug shot. Could be be taken for a HUGE ride.....someone trying to DISCREDIT all who believe this story? Rush certainly acted like he didn't want much to do with it. hmmmmm.....kind of reminds me of the Carvile wife-beating story.

You have hit the nail right on the head. That Scott Ritter would do something like this does not shock me one bit. However, the bigger question IMO is why a prosecutor would put at risk her job to protect him from the charges.

Something is fishy about this story and I'm hoping a good detective/reporter figures it out.

"I stand by my theory that he was useful to someone as an anti-administration voice, and they covered the arrest up to preserve his usefulness. Once 9/11 happened, he started showing up on all the talk shows, acting quite desperate. Silly me, I assumed at first that perhaps the Iraqis had a girlfriend they were holding hostage. Au contraire. The more I think about this, the more I am positive we need to find out about who in Albany was involved in this and why.
