Seeing as to how this Act has been in effect since the Reagan administration, why hasn't it had those terrible consequences yet?

Oh, it has. I can think of about 5 clients of mine that wanted to shoot me because I told them we couldn't put a building, road or other piece of infrastructure in a certain spot due to a puddle of water (not kidding....a f***ing puddle of water). Ultimately they spent MANY thousands of extra dollars on re-design all because some nitpickers at the state capital chose to interpret a set of regulations in a screwy manner. However, now that the issue is back on the front pages, many states that currently do not have similar regulations will feel pressured to adopt them, thus screwing the private property owners and businessmen even more.
