White House set to stay out of affirmative-action case

President Bush is unlikely to join a Supreme Court battle over whether public universities may favor racial or ethnic groups for admissions.

Two sources close to the administration deliberations told The Washington Times that the White House has received a legal brief from the Justice Department backing white students who say they were denied admission to the University of Michigan because of "race-conscious measures."

TLB--when there is a case brought in this country and it works its way up to the SCOTUS, I don't WANT my president filing a brief. The whole point of separation of powers is that the judiciary is to be SEPARATE from the executive (and legislative) branch. The justices have to be above reproach, and allowing a presidential brief doesn't serve that role. If the president wants to tell the country his position, he can release a press statement or call a press conference, etc. He shouldn't be interfering with the judiciary.

Plus, when they finally DO outlaw AA, I want it to be free and clear and above allegations of influence. If Bush files a brief, that decision would always be tainted with allegations of presidential influence, which is what SOP is designed elminate. It doesn't have anything to do with his commmittment to being conservative or not.

I was not posturing on Bush's position. I am just saying that, inasmuch as getting involved means filing a brief, Bush needs to stay out of it.

There are times when the best action is no action. President Bush knew this lawsuit was working through the ranks of the American judicial system. Let's ignore the SOP issue for a second. He had two choices---1) make this his banner cause in a time when national security is a hell of a lot more important or 2) shut the heck up and let the judicial system do its job. Especially when he is pretty sure they're going to go his way anyway. The only thing option 1 guarantees is a racist label from the press/democrats. Nothing to be gained by that--the judiciary is going to hand him a victory on a silver platter if they outlaw AA and President Bush has spent no political capital on it. Genuis, once again.
