Carjacker shooting "justifiable homicide"

B.J. Brown, the man who shot and killed a suspected carjacker in Antioch Sunday morning, will not face charges from Metro Police. The shooting has been classified as justifiable homicide.

Police say Brown was parked at the Golden Gallon off Haywood Lane when one of the carjack suspects jumped into the back seat of his Ford Explorer and threatened to kill him.

Police say Brown grabbed a .44 caliber revolver from his floorboard, jumped out, and shot the suspect in his backseat through the window. The suspect died at the scene.

Legal expert David Raybin says state law is clear that Tennesseans have the right to defend themselves.

"Self defense will allow you to use deadly force to protect yourself or a loved one, if you are reasonable fear of death or great bodily injury," said Raybin.

Raybin says the shooting would not be justified if the suspect had been fleeing. That's what happened in the case of the second carjacking suspect, 20-year-old David Lee Moore. He ran away and was caught by police.

"When they are running away and are no longer a threat, you cannot pursue them and kill them," said Raybin.

The dead suspected carjacker was identified by police Monday as Jerry Williams Jr., of Wallace Road, a 25-year- old with a police record, including two aggravated assault charges. Detectives now believe Williams was unarmed. Raybin says that doesn't matter. What matters is what the victim thought.

B.J. Brown declined to talk on camera. He told me Channel 4 he was sorry that it happened, but says, he had no doubt they intended to kill him.

"State law says you can be reasonably mistaken. Some folks say they'd rather be tried by 12 than carried by 6," said Raybin.

Raybin says a different set of laws apply if someone's breaking into your home. "You don't have to wait until they get inside. You can shoot to kill to protect yourself and your family."

Yeah.. if someone is stupid enough to threaten my life rest assured he doesn't want to hang around long enough for me to do something to make sure he's not in a position to deliver on the threat.

My first thought was, hooray, finally some good news on which to end the year. But then, it does not feel right to celebrate someones death (please do not think I am against the death penalty).

Though I know we all bear responsibility for our actions, we still can only operate on the information we possess, tempered by the values we have been taught. I am assuming that the dead young man was woefully lacking in "good" information and in values.

The blame for this situation lies mainly with those who claim to be doing the most for these young people and I do not need to tell anyone on this website who those persons are. The indifference of the majority of Americans is also part of the problem and also why thousands of people find it necessary to come here.

I don't think the majority are indifferent. They've just given up trying.

Anyone who speaks out about the lack of values and morals in many inner-city black communities is immediately branded as a racist, and all rational discussion about solving real problems, immediately ends. Those doing the branding are the typical "civil rights" idiots like Sharpton and Jackson who have obviously been so successful in leading their followers onward and upward < /sarcasm>.

People don't like getting beat over the head for trying to do what's right, so they stop.

BTW, in this case, I would bet money that the carjackee/shooter was also a black man. If not, this would have been reported as the racist shooting of a poor, downtrodden, slightly misguided black youth at the hands of a rich white male oppressor.

Disregarding my probably-too-flip comment, I would really rather not see stories like this. Once the carjacking attempt is made, however, I don't mind seeing this outcome, as it is a *powerful* deterrent to others. Word gets around on stories like this. People's behavior changes.

Thanks for posting ... this is exactly how it should work. The perp is dead, the armed citizen safe, and officialdom walking away from a righteous shooting.

Am I sorry the perp died? No. He made his choice, and choose poorly. I believe stupidity should be painful if not lethal.

My CCW is a Charter Arms Bulldog .44 SPL but when I travel away from home I like to augment it with my anti-carjacking weapon, a 45 LC derringer, a #2 shot .410 in one barrel and a 3 pellet 000 buck in the other.

Pulling both triggers at the same time is somewhat akin to having a hand grenade on a short stick but you surely want to be on my end of the stick :->

Yeah you have to let em go so they can come back and kill you later so you cant testify against them...the Police will protect you....only they didnt protect you in the first place...hmmm

I love a story with a happy ending.

It's not over. This young man's family can file a wrongful death suit and bankrupt Mr. Brown defending it. It has happened countless times. Criminal charges aren't brought but the perp's family wins.
