There may be a problem with determining if both were really consenting... would a person on exctasy or LSD some other drug play along with this and not grasp what happened to him?

Can mentally defective adults' word of consent be considered legally binding in a case as extreme as murder?

Since the 'victim' is no longer around to be evaluated or to testify one way or another, it's impossible to determine if he was of sound mind. This would be the case in any situation where one person dies at the hands of another. For that reason it should be treated as murder even by libertarian standards. Murder is illegal; the definition of murder is killing a fellow human being. The only exceptions to taking human life are in self-defense and those powers granted to government by the people under the law. Murder isn't defined by the willingness or unwillingness of the victim, although perhaps some in the euthanasia crowd believe it should be. I don't know if they have an official stand on it and from what I understand, not all libertarians accept euthanasia, so certainly not all of them would accept this as a reasonable act of consenting adults to be protected because many know that it would make it easier to kill and get away with murdering competitors or political enemies, and that of course is a bigger threat to our liberties as a whole than if people are restricted from such insanity by law.
