Published in the Asbury Park Press 12/03/02 Fire alerts authorities to nearly 500 weapons By MICHAEL CLANCY STAFF WRITER FAIR HAVEN -- Three dump trucks removed an arsenal of live ammunition and almost 500 weapons -- all of them apparently held legally -- which police found in a home after the fire department responded to a chimney fire and the homeowner threatened the fire chief with a rifle, authorities said yesterday.

What "right" does the Chief have? Is it in the State Constitution? Authority is not a blanket proposition. Just because the legislature passes a law/statute, does not mean that that power is legal when weighed against State/Federal Constitutionality.

Is it legal for a government agent to order you off of your property against your will without some type of due process? Can the meter-reader for the muninciple gas company order you out of your house so they can read your gas meter? Can a police officer impound your vehicle, even though it has never left your property?

If the basis for the law has no standing against individual Rights, then that Law isn't really much of a law, is it?

Wow. Those libertarian training courses are really working. You sound even more stupid than usual.

Do us a favor. File a suit for a permanent injunction against your fire department, prohibiting them from entering your home unless you expressly say it is OK. In the event you are unconconcious or unavailable, they can't enter unless they've gotten approval from a court.

Next, notify your homeowner's insurance that you've taken this action in the interest of liberty. Also, advise your neighbors, so they know that if your house burns, theirs will probably be next.

Think about it. Why would you want to point an un-loaded gun at someone?

Because you're trying to get the fire-chief, who has no idea if the weapon is loaded or not, to back off? Why would you want to tell the fire chief he has no right to remove him from his burning home? They're trying to to their job and save his home, and that's all they're trying to do, and they don't need idiot civilians getting underfoot in the process. That's the real question here. A responsible, reasonable gun collector who had his head screwed on straight would be outside the home telling the fire chief, "I have a large gun collection in there. It's all legal. Please do your job and don't mess up my guns." That's what a right-minded citizen would say. But no...here we have some fruit-loop "defending" his burning home against the eeeeeeevil fire department, of all things. The Founding Fathers would have let the fire department into their homes.

Yes, actually it is safe to assume that. You might not be 100% correct, but it is safe to assume anyway.

The Fire Chief in this case has almost 100 years of common law on his side. Some "conservatives" have respect for that as well.

Fine, but I prefer to withhold judgment until I see something more conclusive than a vague newspaper article. I guess that makes me an anarchist or something.

He didn't actually point it at anyone and we only have the Chief's word that he "thought" the guy was going to point it at him.

You can be charged with armed robbery, even if you're using a toy gun.

My hubby doesn't keep any guns in the kitchen. However, I do.

Don't hide a revolver in the broiler pan! Some local guy did that back in the 80s. He forgot it was there when turned the oven on to preheat it, and the thing shot him in the back as he watched tv.

I'll note for the record that the guy was an idiot and was violating many, many rules of gun safety like leaving loaded handguns all over his house

I take issue with that. Having loaded handguns around the house is not unsafe. Why would it be?

Yes. Mr. Arford should get all his legal weapons back as soon as he is freed from prison for his crimes, assuming his state allows ex-felons to own weapons.
