So why does red pen count? There is something missing from this story. Abandoning the court challenge simply doesn't make sense. The votes were hand counted but then not counted. Weird.

I would agree, except the dems DID accept some votes when ink was used:

Ballots which were marked with RED pen – but which broke evenly – were allowed. Fossel down 4.

Either allow all of the votes where a pen was used...or none.
