Considering thimerosal is not an "adulterant or contaminant" but a preservative, it sounds like a reasonable inclusion.

Not to mention the fact that the vaccine that is accused of causing autism is MMR, and that vaccine never had thimerosal.

My question would be 'is it retroactive?' if the suit is already filed then this may all be a moot point, unless they argue that the date the case is settled the law on the books that day is the one to go by. Either way you can open a can of worms (he was 16 when he killed them, but will be 18 when found guilty and sentenced, etc)
