My question would be 'is it retroactive?' if the suit is already filed then this may all be a moot point, unless they argue that the date the case is settled the law on the books that day is the one to go by. Either way you can open a can of worms (he was 16 when he killed them, but will be 18 when found guilty and sentenced, etc)

The amendments made by sections 1714, 1715, and 1716 shall apply to all actions or proceedings pending on or after the date of enactment of this Act, unless a court of competent jurisdiction has entered judgment (regard- less of whether the time for appeal has expired) in such action or proceeding disposing of the entire action or proceeding.
