Snipers CAN'T get death penalty in MD!

Welll...guess what? According to the Baltimore County Prosecutor on the Ron Smith show, the Sniper CAN NOT get the death penalty in Maryland. Only "Mass Murderers" NOT "Serial Killers" are eligable. Go crazy and kill 'em all at once in the same place, you get the needle nap. Cold blooded, calculated, serial murder and terrorism gets you a lifetime of 3 hots, cablevision, and weight-room privileges. Go figure.

Maybe MD can manage some terrorist or civil rights law. Or, we can just let Virginia do the honors.

I agree, let VA take care of the trial and execution. Personally, I have no problem with killing the 17 year old either (in case that's an issue for any bleeding hearts out there).

Some of this is from qualms about certainty of proof in historical capital cases. Most murderers don't do it with an audience (at least one that stays alive).

Virginia, IIRC, has drastically curtailed appeals on capital cases. So this sniper might get the needle as soon as 3 years from now.

Waste him. Last I heard he is not talking. Throw them both in the chair. There actually is a moratorium on executions in Maryland to be more specific. Thanks to their governor.

Accessory to murder probably won't qualify for execution, but if the kid doesn't rot in jail until he dies I'll eat my hat.

Under attorney's advice, to be sure -- and I, for one, don't really care. That will be worked out in due time. The sniper has been stopped and there is no one else to catch.

These cold-blooded b*tch*s will get the death penalty one way or the other. I believe this for the elder of the 2, The younger may only get a multiple life sentence.

It should become an issue in MD. I would like to hear KKT argue the worth in keeping these terrorists alive.

Even though more killings took place in MD, the perps should be tried where they will face the greatest punishment.

Does Alabama impose the death penalty? One could argue that they should be tried there first, since that is where they began their terror spree.

Actually, the only reason I could think to keep these guys alive is if they are in fact related to AQ, hence having some value for intelligence in the prosecution of the war on terror. Or keep them alive if they are related to Nation of Islam or the New Black Panthers party. For example, in the OKC case, McVeigh died with knowledge that would be useful in light of the fact that the FBI has to re-open the case to examine the Iraqi connection. (Well, maybe not if you're the FBI - egg on face, or worse). It would be a shame if these terrorists were killed while in possession of information that could conceivably prevent innocent deaths in the future.

I heard that the gun was not connected to Alabama though and that it was a finger print on an actual magazine not a gun magazine of the 17 yr old. He won't get the chair there.

I heard on Savage tonight that even IF MD does get the case and prosecute's, VA, still holds rights to prosecute as well, not to mention the Gov't as well; which will take it to VA...Savage mentioned something out of Article 4 of the Constitution pertaining to the Gov't right to retain right's for prosecution if the Gov't has issued the "warrant" first...
My wording is not correct in the last, but in a nutshell, if the Gov't say's "this is our deal, we retain rights", the states must conceed...I'm still trying to find the subsection...will try and post it when I find it..

It will be interesting to see how prosecuters go about proving beyond a reasonable doubt that JM pulled the trigger for a particular murder, considering that both on them were together and neither is talking and they have NO witnesses who saw either one shoot. Both had access to the weapon and JM's fingerprints on it would not prove he shot one person in particular. I'm not saying it's impossible to prove, only that it will interesting to see how they do it.

I would imagine his attorney will fight hard to keep all the cases separate.

Unfortunately, that is not correct. Prison inmates get a whole lot more privileges than that.
