If the witness saw an AK type weapon with an orange clip, it would be possible. Otherwise I agree with you. The problem is we are not privy to the testimony of the witness. We do not know if the witness said AK-74 or whether the police put it together.

IIRC, the witness who saw the shooters clearly, as they backed out their van, was not the witness who saw and recognized the gun.
