Simple, because Congress is consenting to the transfer of power. It would only be unconstitutional if the President declared war without being given the authority by Congress.

So the Judicial Branch could also consent that it's powers be transferred to the executive without any Constitutional amendment?

Since the powers of the Federal government are narrowly defined in the US Constitution, where in it is the Congress allowed to transfer powers to the Executive branch?
