Carr trial: Survivor describes sexual attacks by armed intruders

WICHITA -- Her voice steady, the sole survivor of a quadruple homicide graphically described for jurors Tuesday the sexual attacks she and her four friends endured the last night they spent together.
Defendants Reginald and Jonathan Carr stared at the woman as she recounted in detail how the five friends were forced by armed intruders to have sex while the intruders watched, and how she herself was raped.
The Carr brothers are on trial in Sedgwick County District Court charged with 113 criminal acts, including capital murder, stemming from a series of crimes in Wichita in December 2000. Prosecutors are seeking the death penalty.
In the most notorious of the crimes, the brothers are accused of abducting five people from a Wichita home the night of Dec. 14, 2000, forcing them to withdraw money from automated teller machines and shooting them in a soccer field early the next morning. Killed were Aaron Sander, 29; Heather Muller, 25; Brad Heyka, 27; and Jason Befort, 26.
The survivor -- then a 25-year-old fifth-grade teacher -- testified Tuesday she had graded papers the afternoon of Dec. 14 before taking her pet schnauzer and heading to the townhome that Befort, her boyfriend, shared with the two other men.
Befort, a junior varsity basketball coach at Augusta High School, was still at practice when she arrived, but his roommates were home, and Befort and Muller arrived later.
The woman testified she watched "ER" and made Befort a sandwich before the two of them went to bed for the night. He shut off the lights and locked the doors before going to bed at 10:45 p.m.
Sometime after 11 p.m., the woman testified, they heard Sander talking to someone at the front door, and a man burst into the bedroom moments later. A second armed man brought Sander into the room and gathered the other occupants into the room.
The survivor said the sexual attacks began with the men forcing the two women to perform sexual acts while they watched.
She told how each person was taken to an ATM to withdraw cash while the other intruder stayed behind, forcing the others at gunpoint to engage in sex with each other.
She was raped by the first intruder, she testified, and was taken by the second man to the ATM. When he asked if she had enjoyed it, she said yes, hoping to appease him. In answer to his question, she testified, she told him she had never had sex with a black man before.
He nicknamed her "Shorty" and told her it was too bad they didn't meet in other circumstances because she was cute and they would probably have gone out, she testified.
"I asked him if he was going to shoot us. He said no. I asked him again and I think I said, 'Do you promise?' And he said, 'Yeah, I am not going to shoot you,'" she testified.
Back at the house, she was put in the closet with her other friends and told them what he had told her.
"I told Brad, Jason and Aaron 'I think we are going to be OK. I asked him and he said he was not going to shoot us,"' she said.
But that changed later that evening just before the second intruder raped her, too.
"He said, 'Don't worry, I am not going to shoot you yet,'" the woman testified.
Her testimony resumes this morning.
The Carrs also are accused in the Dec. 11, 2000, shooting of Ann Walenta, 55, who later died. The case also includes a Dec. 7, 2000 robbery where Andrew Schreiber was abducted and forced to withdraw cash from an ATM.
In earlier testimony Tuesday, a nurse practitioner who examined the sole survivor of a quadruple murder described in graphic detail for jurors Tuesday how she collected evidence of the woman's sexual assault.
Debbie Wendt, the sexual assault examiner, told jurors the woman was very intent to give her information about what happened to her and was intent they collect whatever evidence necessary.
"She made several statements like, 'I don't want you to forget about this, please write this down,'" Wendt said, adding the woman was very willing to tell her story and tell where there might have been evidence on her body.

They had reports form the courthouse all day yesterday.
In the same situation, I would have to assume that we are all as good as dead, and if I give my life for the others, so be it. I think I'd rather die than suffer an indignity like this. As I say, begin with the assumption you're dead anyway, and go from there. Better to take a perp with you than die pleading.
I will aggressively pass on what I hear from your list to quite a number of non-freeps.
