The executive director of a law enforcement group that endorses Republican gubernatorial nominee Bill Simon said today he had two photos showing then Lt. Gov. Gray Davis accepting a campaign contribution in his state Capitol office -- in violation of the law.

This on top of another recent report of oil company that won state permission to increase toxic pollution into San Francisco Bay by nearly 400 percent -- just four months after donating $55,500 to Gov. Gray Davis .. report

I hope tihs is true, and this is why he hasn't brought the photos out yet. He's fishing. Getting some RATs on record as saying they don't exist because it never happened. Then WAM! the photos drop. Or he has photos, but you can't tell if it's a check or a thank you letter, so he's trying to get them to fess up.

the report on the radio here on the East coast said Simon had borrowed to raise his own $$$..that he will govern with his mind and not his heart enforcing the laws that are on the books.

LOS ANGELES (AP) - The executive director of a law enforcement group that endorses Republican gubernatorial nominee Bill Simon said today he had two photos showing then Lt. Gov. Gray Davis accepting a campaign contribution in his state Capitol office -- in violation of the law.

Monty Holden, head of the California Organization of Police and Sheriffs, told reporters the Jan. 31, 1998, photos show Davis, then campaigning for his first term as governor, accepting a $10,000 check from Al Angele, then executive director of COPs.

The photos show Davis standing next to a man identified by COPS as Angele. They are holding either side of a $10,000 check as they stand in an office, that according to COPS, was the lieutenant governor's office.

The claims are ``false and possibly slanderous,'' Davis campaign press secretary Roger Salazar said. ``This charge is categorically false. No such exchange of campaign funds took place inside then Lt. Gov.'s Davis' Capitol office in Sacramento.''

Davis said the meeting took place in his campaign office in Los Angeles, which would not be illegal.

Simon initially made the allegation Monday after the candidates met in Los Angeles for their first debate before the Nov. 5 election.

But Tuesday, Simon backed away from the allegations, saying it was a matter between COPS and the Fair Political Practices Commission. ``It's not my allegation ... this is California Organization of Police and Sheriffs speaking, not me,'' Simon said KGO-AM.

During the debate, Davis cast Simon as too conservative for California and Simon accused Davis of running a corrupt and failed administration.

``Mr. Simon is a true-blue, think-tank conservative. ... He is simply out of step with the values of most Californians,'' the Democratic governor said in his opening remarks at Monday's hourlong debate sponsored by the Los Angeles Times.

Simon responded by accusing Davis of linking policy decisions to campaign donations, mismanaging the state's energy crisis and turning a budget surplus into a $23.6 billion deficit.

``What the people of California deserve to hear, but what they probably won't from Mr. Davis, is an apology,'' Simon said, `` ... an apology to all Californians for a disastrous four years in office.''

During a news conference after the debate, Simon said he had evidence about Davis and the illegal campaign contribution.

He said there was a letter from COPS to the Fair Political Practices Commission.

Before Simon's staff could produce the letter, filed earlier Monday, Davis aides contacted the former member it named and he categorically denied the claim.

Angele called the charge by current COPS members ``totally unbelievable.''

``I've never been in (Davis') office in my life,'' said Angele, now a Davis appointee to the Board of Prison Terms. ``I don't understand it. It's out of left field.''

During the debate, Davis highlighted Simon's opposition to abortion, new gun laws and some environmental regulations, and touted his own accomplishments in education, health care and transportation. He criticized Simon for failing to produce a budget plan of his own and sought to portray him as inexperienced.

With less than a month until the Nov. 5 election, Simon trails Davis in polls and would like further opportunities to confront the governor in person. But Davis agreed to no other debates beyond Monday's.

Fair enough, but Gray-out Davis has a 5X cash advantage 30 days prior to election day. In a large state like CA that's difficult to overcome.

Accusations against Davis resurface

By Sam Stanton and Denny Walsh -- Bee Staff Writers Published 2:15 a.m. PDT Tuesday, October 8, 2002 In a move that could renew charges that Gov. Gray Davis engaged in improper campaign fund-raising tactics years ago, the U.S. Supreme Court declined Monday to hear an appeal in the case that would have forever kept the accusations against him secret.

The decision lets stand a 9th U.S. Circuit Court of Appeals ruling that a federal judge in Sacramento must release documents containing allegations about Davis' conduct when he was an assemblyman in the 1980s and later state controller.

The judge must release the documents "forthwith and promptly" after receiving notification from the 9th Circuit, said attorney Rex Heinke, who represented The Bee in a suit to gain access to the documents.

Davis' spokesmen have denied the allegations, saying they come from a convicted felon who invented the tale to seek early release from prison.

The Bee's lawsuit involves an old criminal case against disgraced former state Coastal Commissioner Mark L. Nathanson.

He went to prison in a bribery scandal disclosing that he had sought payments from individuals with business before the commission.

As part of a bid for leniency after his indictment in 1992, he offered to provide information to prosecutors about alleged misdeeds by a "high political figure," according to letters his attorneys provided to prosecutors.

The letters became part of the court file, but U.S. District Judge Lawrence K. Karlton ordered them sealed after The Bee discovered their existence years later and asked for copies.

In December 1999, Karlton released versions of the letters with the names blacked out, although numerous sources have said the letters refer to accusations against Davis.

Sources have told The Bee that the letters indicate Nathanson had accused Davis of seeking campaign donations from people who, with Nathanson's cooperation, would get favorable treatment by the commission.

But Karlton ruled that the letters "contain no newsworthy information" and that the accusations against the politician could harm that individual's reputation.

The 9th Circuit overturned Karlton in December 2001, ruling that there was "no adequate justification" for withholding the documents.

But the letters were not released because an unnamed "private citizen" appealed to the U.S. Supreme Court to keep the names from being revealed.

The high court decided without comment Monday that it would not review the case, meaning Karlton will have to release the unredacted letters. P> However, it's uncertain whether that will take place before the Nov. 5 elections, in which Davis is seeking a second term as governor. Technical legal steps remain to be taken before the judge must release the letters.

The accusations against Davis involve alleged activity long before he became governor and never investigated because officials decided they could not trust Nathanson. Prosecutors have also argued that, even if true, the allegations may not be provable.

But the Democratic governor has been dogged throughout his re-election campaign by claims that he is an overzealous fund-raiser and has tied official acts to contributions, something he has angrily denied.

What the news is saying on the East Coast is that the story was even downplayed on the Dioxin alleged payoff for the permit..and wondered why more media out in California arent finding its importance to the campaign.
