Barone is hammering them on Federal law dealing with military overseas ballots. He is taking them to school. Chief Justice asks what law he is quoting and he NAILED HER! This guy is not going down without a fight.
Yeah Lisa. This part is particularly fun because the precedents and cites are about the 2000 presidential election.

The administrative work to replace the already issued absentee ballots also REQUIRES the person REQUEST an absentee ballot...so, the person has to REQUEST another ballot from overseas, and then another one has to be PRINTED and SENT to the person...

I'm going to file my tax return on April 16th next year and argue that the April 15th deadline is irrelevant and that it is adminstratively feasible for the IRS to process my return even if received on the 16th. Will I win?

I just called the NJSC number and told them that I find it absolutely appalling that a Supreme Court is taking a survey. She said, "well, we are just looking for public comment." I said, "who is going to read the comments? The justices?" She said, "yes." I said, "to what end? What they are really doing is taking a poll and I believe that to be conduct unbecoming of a Supreme Court." She tried to say it isn't a "poll" but I boxed her in. What a joke!

Torricelli just made an announcement. Here's the rush transcript:
"We have explored legal options and it appears that the powers that be will not permit the Democrats to place a new name on the ballot this November. First, I ask the Republican litigators, 'when did we become such an unflexible society?'
"Despite this thwarting of Democracy, and this shameless Republican effort to silence the voice of the people of New Jersey, we have come to a solution.

Chaffee has said he has been disgusted with the dems the way they are holding up things and in particular, on the judiciary committee level. I would hope that this would further solidify his disgust.

Good for you. Of course it's a poll. The Dems can't make a move without an opinion poll. God forbid they form a decision based on law and ethics.

Some wag once said one should never watch sausage or laws being made.
All government resolves into a contest for power. And there are no rules. There is only power and what the players can get away with.
Morality can not be legislated. The desire for power can not be conrolled. It can only be partially limited with process. Sometimes but not alwawys process succeeds over efforts to exercise power.
The real world is not what they taught you in school. You can resign from the real world or engage in the efforts to limit and control the exercise of raw power. Those are the only options.
You can't win if you don't understand the game. Winning is not everything. It is the only thing.

The justices seem to be suggesting that, if they're already in violation of federal statute by not having mailed out all the military ballots by 35 days before the election, it doesn't matter if they delay that mailing further.
