I agree with you. It is to our advantage that this is BEFORE the election. Lautenberg is not really a good candidate. If we appeal to the USSC it will hurt Jeb in Florida and other close races. If we accept the ruling here, we can campaign against Lautenberg as the "bait and switch" candidate, as hchutch has suggested.
I think Lautenberg has some stuff that might look bad in the current climate of national security.

Control of the Senate is very important. No, it is not of presidential importance. But I think it is a big enough issue that the USSC will hear the case on an emergency basis. Control of the Senate changed when Jeffords changed parties. Control of the Senate is a political matter, not a judicial matter.

Appellate argument is tough . . . but if you are getting hammered you need to call a spade a spade and get the most powerful arguments on the record. The crap about the N.Y. statute is completely disingenuous and he should tell the Chief Justice who handed the argument to the Democrats that it is. He should go down is a blaze of glory because the arguments won't make a difference.

Judge Neopalitan said on Fox last night that the tradition in NJ was that a democrat replaced a democrat and a republican replaced a republican on the NJSC regardless of the party of the governor. That kept it 3-3. But the gov's party determined who sat as Chief Justice, determining the 4-3 mix.

Saying the right to vote is protected by Congress, and protected over absentee and military voters. This is another part which will be get this to the USSC. He stated that the state can not trump the federal rights of these voters.

This shows what a sham and dog and pony show this is. A state supreme court taking a survey. To accomplish what? Their job I thought was to interpret the law, not to make law or take a survey to aid in their decision. Am I to presume that the survey will be open until the opinion is to the satisfaction of the Justices.
These justices sound like they will make the FlaSC Justices look like Oliver Wendell Holmes.

The New Jersey Supreme Court is taking phone calls nationally in order to "poll" on this issue. And why would a poll be in any way RELEVANT to how a JUDGE should be INTERPRETING a LAW ?!?!?

The woman Chief Judge sounds like a moron. In any case, her whiny question:"what's the big problem? Other states have shorter time limits?" is so totally stupid. She is supposed to be the Chief Judge of NEW JERSEY!! She is supposed to uphold the laws of her state.
If Roe V. Wade were overturned, and some other state outlawed abortion while NJ kept it legal, would she say, if some local prosecutor decided to prosecute an abortionist: "well, what's the big deal, other states have outlawed abortion?" I can't believe this jerk graduated from law school or passed the bar exam.

Yes, NJ REpublicans are also the idiots who controlled both houses of the Legislature (and thus redistricting in 2000) by a wide margin. Being the bipartisan dolts they are, they gave up this advantage in its entirety and agreed to a plan to turn over redistricting to an "expert" who would select parts or all of competing plans. The "expert" was a liberal Princeton professor who, surprisingly, picked the exact plan favored by the Democrats. The leaders of the legislature pouted when their favored candidate lost in the primary and refused to give strong support to their Guv candidate, Bret Schundler, and thus lost the senate by one seat. Talk about STOOOPID.
