Well, if he announces his withdrawl from the election but will finish his term then no the GOP wont gain control. But if he resigns his seat effective today, then yes, the GOP will regain control unless McGreevy appoints someone to fill his seat. And if he does that, then there will be no election in Nov and the replacement will serve for 2 years.

Their will be an election in November for the six-year term. The rats are simply trying to replace Torch with a less ethically-challenged candidate.

With regard to a federal constitutional office, state law cannot be interpreted to override federal law which mandates the November election for this Senate seat. Think Supremacy Clause.

If he resigns, the Senate will be 50-49 to the Dems/Independents. So it will still be Dem-controlled.

I'm not so sure about that. If that were true, then all senators would quit right before the election, thereby cheating their opponents and their constituents out of an election. Toricelli cannot possibly have the legal power to eliminate an election all together.
