Thus his name will remain on the ballot, and someone will wage a write in campaign. Bubba would be best for this job.

Lucky for the good guys that a large constituency of the democrat party can't put an X in the right box, no less spell Bubba.

So on tonight's news, FOX concludes that there is no way the DEM ploy in NJ courts will fly. On CNN the talking head concludes they will succeed. You say?

Fox is correct, and CNN is wrong, and I say that with a high degree of confidence. Yes, I know it is odd for me to be the messenger of good news. My role is to be more of a cold shower kind of guy around here. :)

We had a large write-in vote in our town and the organizers pre-printed small stickers that were placed on the paper ballot machines and their use was upheld at the trial level of the court, but no appeal was taken any higher!

Of course, with electronic machines, the voter can't apply a sticker, but can stick it on a hand to ensure the correct spelling!

What I've heard is if Torch resigns then the appointee would automatically be on the ballot as the incumbent.

Is this wrong? That's what Napolitano said would happen. Still sounds unfair to me.

That's what I read, but as I understand things, it is also in conflict with federal law, which trumps it. But I'm not a lawyer, just going on what I'ver read here.

Even against the Crook, Forester is apparently still under 50%, so they think he is still pretty vulnerable.

That is not a guarnantee, but it is a more likely route than the one that the Demonrats are going down....

Yes, but notice that they keep screwing up and ultimately failing. The Clinton schemers are gone. The Clinton magic is gone ...They have nothing left to offer but entitlements, and nothing to strive for except their naked lust for power. The public has woken up to this.

Sure hope you're right. I believe 9-11 HAS reduced the electorate's tolerance for liberal BS politics. I hope they reap the full measure of what they have sown. That would be true justice, 'eh?

I completely agree with the fact the RATs have no legal basis, but they do have a few options.

1) Don't worry about the written laws, and get the courts to create new laws based on public opinion

2) Get a bunch of free press for not being allowed to be on the ballot; thus forcing the republican to also request the RAT replacement be put on the ballot. Still not legal, but the courts may do it.

3) Get someone like Bill Clinton to run and then resign and have the RAT gov. appoint the RAT of their choice

4) Excite the electorate by having the USSC rule what the NJ supreme court did illegal (much like Floriduh). Now they will get massive turn out across the land and not have to worry about NJ.

Torch did NOT resign his seat...........he resigned from the campaign and petitioned the US Supremes to remove him from the ballot. There is no precedent for this at all and would subvert the electoral process. Of course, consider Stevens and Ruth Bader Ginsberg are still on the Court.

Not sure if he would get his name on the ballot or not, ...

As I understand it, that is what the Dems are going to court for...to avoid the 51 day law in NJ and get a new candidate's name on the ballot in place of Torch.

And that raises this question -- from where would the Governor get the authority to "appoint" a new candidate to replace Torch. Only if Torch resigns does the Gov. have any power to appoint someone. I guess it would be the state Democrat committee in NJ that selects the new candidate, not the Gov.

Do me a favor, read the law with the hypothetical that he quits AND he's *not* seeking reelection. The Senator's status would have nothing to do with the November election, right? The law is screwed up and, IMHO, the courts will undoubtly point that out.
