The sad thing here is that the probable outcome is that the Senate Democrats, instead of learning their lesson to discipline their own (had they done so early here they would not be in this position), they will probably NEVER even say that their members have done anything wrong, even in the face of overwhelming evidence. I still find it disgraceful that David Chang is in jail and Torch is out and running for Senate.

My reading is that the Governor could only appoint through the end of Torch's term -- January 3, 2003.
As for changing candidates, the deadline has passed. According to New Jersey statutes, it must be done 51 days before the election (which was several weeks ago).
We would only have a Widder Carnahan situation if Torch stays on the ballot and wins on November 5. If Forrester wins, then all is moot.

Sen. Bob Torricelli of New Jersey, under fire for ethics troubles, is considering ending his campaign for a second term, a senior Democratic Party official said. As the party waits for Mr. Torricelli's decision, the party is exploring its legal options for getting a replacement candidate on the November ballot, according to the official.

The RATs are full of dirty tricks That's the only way they can win elections. You have to see the anti-gun smear ads that are running against Forrester -- the one with the soccer moms sitting around taking about how dangerous NJ will become because Forrester wants to let everyone carry guns -- the same ad tactics they used against Bret Schundler.

Maybe the DNC threatened to pull the plug on finances, and the Torch responeded by threatening to withdraw and thus hand the seat over to the Republicans. Maybe just some head games going on here. Just a thought.

What are the state laws regarding candidates? Are there no deadlines for filing? I am sure the DNC has some trick up their sleeve. Its too late to put another candidate on the ballot but they are thinking of running a write-in campaign for a Democrat currently in Congress. Or at least thats what I heard on CBS Radio News while waiting for Rush to start.

From what I gather (although bear in mind I have no ideas about NJ state election law)...Torricelli -could- drop out now, and have McSlimey appoint his replacement (in fact, if the negotaitions are serious, the NJ Dems probably have someone in mind already)immediately. However, any appointed Senator's name would NOT appear on the ballot. It would still be Torricelli's name on the ballot. Very similar to MO in 2000. If Torricelli outpolled Forrester, would that mean that the appointed Senator would actually be the "winner"? In this case, I think it's a lost cause...MO was different in the case that Carnahan was a popular Governor. Torricelli is faaaar from popular right now. If Torricelli pulled out, the only way Forrester could lose would be if a) Torricelli outpolled him (not gonna happen) or b) a write-in Dem got more votes (also not gonna happen).
IMO, the Dems have written off this seat, and are switching their $$ and attention to MO, MN, and SD.

No, if a vacancy occurs /in 30 days of the election, a replacement can be appointed, and then settled at the FOLLOWING general Election.
