Depends on what provacation there was on the first attack. I know you & I don't agree on Pits, we've had this discussion before. They should be treated like any other dog, if the law say's they have to be destroyed after the first attack. So be it.

True, I was making the assumption that the animal was not on the owner's property defending against an uninvited intruder but attacked someone there or elsewhere without being provoked.

You are right, we disagree. I believe the animal is dangerous and should be subject to the same rules as lions, tigers and bears. (Oh my)
