Congress is only consulted out of courtesy from the executive branch. They are only required for a formal declaration of war. Since this will be legally an extension of the 1991 effort and already blessed by UN resolution, there really is no need for a formal declaration. Now if they choose to declare war, then congress will have to formalize this but there still is no need for them to be in the loop for operational planning or have knowledge of the first strike timing.
