What part of your example is not covered by the phrase, "and the trial properly conducted"?
If evidence is improperly withheld from a trial, the appeals court will ask for a retrial.
But the appeals court cannot (usually) second guess the jury on the truthfulness of witnesses or the sufficiency of evidence to prove the case.

I am not a Westerfield supporter. I just want to make certain that the facts support the verdict. My heart goes out to anyone losing a child. But I also want to make certain that someday my child will not be convicted in a court of law on the basis of fuzzy thinking. None of us are exempt.

I saw that they busted up a ring in Fresno and Poway a few weeks ago. Do you know any of those involved?

It is a right specific to an accused held in custody. In other words you can't hold someone in custody based on an unproven complaint forever. The defendant has a right to have the charges against him heard quickly if he so desires rather than languish in jail.

Her parents weren't on trial in this case, Westerfield was. They weren't on trial, but IMO, they supplied enough reasonable doubt to aquit.
Because the parents had a creepy lifestyle, does not mean that Danille needed to be murdered.
You have a peculiar sense of justice.

Defendant has the right to a speedy trial. In this case defense did not waive that right. It was a defense strategy to force the prosecution to bring the case to trial with the evidence they already had and not be able to do a more extensive investigation.

Whew! Thanks for your voice of reason. I was beginning to think I was in some sort of co-dependants anonymous meeting or something. Time to move on, folks. I can't help but think of how hard Westerfield would be laughing if he read this thread. There have been hundreds of lurkers on this site reading the posts everyday like myself, finally we can expose ourself without getting flamed (wink wink). I'm glad the jury came back with the guilty verdict, my thanks to ~Kim4VRWC's~ for hanging in there and taking all the heat for us...
