I get it now... The defense was required to submit there witnesses for the penalty phase in case of conviction and they failed to meet the deadline set by the judge. Those are the 10 witnesses that are supposedly out of state. Makes you wonder about the defense though... It seems the defense is willing to bend the law in relation to discovery issues... Does that speak to the innocence or guilt of the client?
