Did any of the justices desent on that ruling? I'd like to read it. Anyways, in was 1939. What would you expect. FDR had already tried to take over the court and thus grab two of the three legs of power. Alger Hiss, one worlders, commmies, leftists, vegitarianism, etc.... All the usuall suspects.

For the most part modern medicine has cured most common diseases. As you know, what goes on now is either self-inflicted or a function of getting old and approaching death. (As an aside I had close family member of advanced age die of brain cancer, and yet really, right up to the last couple of days, modern medicine managed it stunningly well.) So, anyways, as medicine has become more government run, paid and controlled it isn't surprising that it would parrot the piper. Furthermore there is a hubris that thinks public heath types can succeed where straightforward legislation and law enforcement failed. For example the War On Drugs seems to be moving to be dumped into the medical profession for them to solve (although they dealt with it first, albeit primitively and with out anymore success then anyone else) now it is guns. Lastly, due to physicians long and hard technical training, it isnt surprising that they, as a group, would be ignorant the political philosophies the formed the foundations of our liberties. Have a nice weekend.

Did any of the justices desent on that ruling?That I don't know, but no one was present to argue for Miller which is why the court said "in the absence of any evidence" they could not conclude that a sawed off shotgun had any military use.

I used to have a 4" Colt Python with standard iron sights. One of the drills I used to do was to see how far back I could go and still hit a half torso. It must of been near a hundred yards. The front sight was way fatter then the ever and ever smaller torso. Furthermore I had to aim above the head because of the drop. So the drill became aim at torso, then raise above the no longer visible target. I'd do all that sniper stuff of deep breathing, slow exhale, zen like squeeze. It was fun. Now if I had a 6" barrel...... :)

Actually, the ruling was issued 'by default,' because the defendant had escaped custody (or died, or whatever.)
THEREFORE, nobody was around to state that sawed-off shotguns were military-use weapons.
More to the point, the ruling was in line with the Constitution---it has been SERIOUSLY mis-interpreted and mis-applied by the useful idiots ever since.
