The problem is when people knowingly take advantage of you while you are in that state.

I see your point, but how is one going to prove one was drunk after losing his a$$, in order to get the money back?

Irrelevant as long as he can prove he was impaired. We are going to argue mechanics which is outside our realm.

Here's a similar example: A man goes into a casino and blows $50k. His son comes back in the next day and demands the money back because the father is an Alzheimers patient. If the casino did not know the man had Alzheimers, I don't think the son has a case. If the casino DID know the man had Alzheimers, I think the son has a case.
