Here's a similar example: A man goes into a casino and blows $50k. His son comes back in the next day and demands the money back because the father is an Alzheimers patient. If the casino did not know the man had Alzheimers, I don't think the son has a case. If the casino DID know the man had Alzheimers, I think the son has a case.
