UPDATE ON SAMANTHA (CA) Arrest made in murder!!!!!!!

Update from OC Sheriff... Press conference..

Playing 911 tape of the people that found the body, male caller was extremely upset, and scared, he was crying, and telling 911 the location but the cell phone transmission was breaking up and was disconnected.

They called the telephone number he left before the disconnect and they called his home and got a messege machine. He called back within minutes and made contact again with 911 and was almost hysterical and crying saying it was little girl and was very distraught,

When Cell caller got home he called again from home phone and recontacted 911, 911 said they would pick him up and the he could show him where the body was.

End of 911 tape

Press conference continues, stating over 2000 citizens have given leads......

Another press conference at 6 PM

At 955 AM they made an arrest alihondro avial DOB 3-1375

It just disturbs me that the jury let him off. I guess we'd need the trial record to know the reasons why they acquitted him?

So Avila works in Temecula, which is only 46 miles from the door of the Van Dam home in Saber Springs, Poway, Calif.

After work on Friday, Feb 1, why does something tell me he headed SOUTH instead of North?

I agree, zero tolerance for even first time offenders. In my opinion this is probably a deviant characteristic that can not be rehabilitated. 1st offense castration and life imprisonment.

Not sure why he was let off...looks like there was a witness intimidation charge 2/2000 that was also dismissed or aquitted.

Looks like 2 of the witnesses were the victims or same name as.

Are you really having that hard of time trying to figure out my intent? What I was trying to convey was that if this guy should not have been here, then this crime will transition into a tragedy of enormous proportions to the family who has lost their child needlessly. If he is here illegaly, then it means that this would a preventable crime if our laws on the books had been enforced.

You had to be there. Somebody pronounced his name as ah-vee-AL instead of AH-vee-la as is correct, and I wondered whether his name was REALLY "Avial" or whether it was a mistake in pronunciation or in typing. Has no effect now, it is ancient history now.

I got the impression that they wanted to post his DOB because the name is somewhat common. Hispanically speaking*. And since LEO systems are so disjointed they are likely hoping that some other LEO's have records on this guy.

*I have a lot of hispanic friends. They would take this guy apart (assuming he "did it") with their bare hands just like many of us would if we could.

IMHO, when the acts being depicted (whether real or by virtual graphic) are illegal and/or the depiction is an instruction for such an illegal activity ... it ought to be a felony. That includes kiddy porn, snuff films, bomb making 101, etc

Your opinion is an interesting one. I don't agree with your opinion. I won't defend kiddie porn or snuff films since both involve felonies in their production, if they are real. On a personal level, I think both of these types of depictions are disgusting.

None-the-less, you've added "bomb making 101" to your list. It is on this that I focus my comments.

There are technologies that currently exist that are still VERY PRIMATIVE but are able to in a very rudimentary fashion, interpret brain waves. What I mean by this is, there exist devices that can interpret at least in part in a simplistic manner, what a person is thinking and can record, measure and depict those brainwaves in a consistent fashion. I am not claiming there are machines currently available that can read your individual thoughts because I have no idea if such devices already exist.

However, this technology IS EVOLVING. And I'm certain it is definately within the realms of possibility that within our lifetimes we will see the development of some sort of a device that will be able to receive, record, measure and depict the elecro-chemical reactions within our brains that do indeed occur in the process of thought and memory. Again, I AM NOT claiming that such technologies are fully functioning at this time. I am however claiming that considerable research and development are being expended in this area and I'm reasonably confident that such a device is or will be possible in the near future.

Therefore, IF it were to become a crime to "virtually depict bomb making 101" as you advocate above, and IF America should fall to a tyranical government, then the protections enumerated in our Constitution, would become THOUGHT CRIMES.

I find that unacceptable and therefore I respectfully disagree with you.

I was born and raised in Orange County.Still live there. Perhaps my frustration with this type of incident got in the way of my sounding coherent. I am a safe distance from being an expert in the judicial system.

Frightening. Glad I wan't there to see that guy. Anyway, just to clear things up, my post has nothing to do with immigration, just that one Latino who we don't know is even illegal is proof that "diversity" and whatnot is going to bring in hordes of pedophiles. If anything, I'd think foriegn pedophiles would stay out.

I don't disagree, totally (see my earlier posts re big venomous snakes). But, for now, realistically, prison is viable, if only in the minds of the people doing the sentencing. I don't live in California. I won't be on that jury.
