If her fiance was murdered and did not have to marry her, consider him lucky.

Whoa BSOD !

I take it you have some "issues" with Nancy.

"She walked up to me and she asked me to dance.
I asked her her name
And in a dark brown voice she said, "Layla."
L-A-Y-L-A Layla, lay lay lay Layla.

Well, I'm not the world's most physical guy,
But when she squeezed me tight she nearly broke my spine,
Oh my Layla, lay lay lay Layla, lay lay lay Layla.

Well, I'm not dumb but I can't understand
Why she walks like a dog and talks like a man
Oh my Layla, lay lay lay Layla, lay lay lay Layla.

Well, I'm not the world's most passionate guy,
But when I looked in her eyes,
I almost fell for my Layla,
Lay lay lay Layla, lay lay lay Layla.

Girls will be dogs, and dogs will be girls.
It's a mixed up, muddled up, shook up world,
Except for Layla. Lay lay lay Layla, lay lay lay Layla."

(apologies to the Kinks)

1. Danielle's blood found on Westerfield's clothes.

2. Westerfield fibers found on Danielle's body.

I understand your concern. You have posed some good questions.

And THANK YOU for asking questions instead of trying to TELL EVERYONE how WRONG THEY ARE. Your attitude makes all the difference in the kind of response you recieve, ya know what i mean ?

(1)I think we all are unsure about the tiny blood spot on the lapel of DW's JACKET. There are many theories on how it could have gotten there, that do not involve DW killing her.

Prosecution did not narrow down at time window for when the blood got there, so they actually proved nothing beyond the fact that "DNA from a very small spot , that could have been blood, on the lapel of DW's Jacket was tested and shown to be almost certainly Daneille VD's.

Same with the spot on the floor outside the bathroom, although you didn't even mention it.

If these spots were truly blood from Danielle being killed, WHY is the amount so very, very small. How did DW get 'to' Danielle to take her into the MH and kill her? There is no evidence he was EVER in the VD home. The MH wasn't at his house. He would have had to have taken her in his SUV. There were no traces of Danielle in his SUV. WHY?

Did he and her walk all the way to where his MH was stored?

(2)The FIBERS were not Westerfield's fibers. It was testified that they COULD have been the same as ones from the MH, and the same person said they also COULD NOT have been. She said it is POSSIBLE THEY WERE THE SAME, POSSIBLE they WERE NOT THE SAME. Don't believe me, go read the testimony.

GO back to the beginning of this thread, read forward, you will find replies where the statements are given that fiber testing is non-conclusive and an EXACT MATCH cannot is undeterminable. For instance, DID any of the fibers they tested, that supposedly were found by Danielle's body, and in the MH, match automotive carpet in the Van Dam vehicles ? DID it match carpet in any of the other homes on that block? Did the police even test to see if it DID? Did those fibers match carpet in the police cars? DID they test that? (Remember, it was NYLON fibers, which would pretty much be used in automotive type carpeting, not house carpeting.) THINKS ABOUTS THEM WORDS!

I hope I have given you good information, answered your questions, and you take the info, and come to your own conclusion. Whatever that may be.

Maybe the Short Blue-Grey Nylon fibers came from something like this?

MILLENNIUM POLICE JACKET
100% 3-ply Supplex® nylon
Style Color
530MBK Black
530MNV Navy Blue

FABRIC:

Shell = 100% 3-ply Supplex® nylon
Lining = 100% nylon taffeta
Removable liner = 100% nylon taffeta face and back.

Sorry don't know how to post picture but here is link:

So is it your contention that if a forensic team came into my home and my neighbor's home--with different carpet, which has been established here--they would find all kinds of similar-in-every-way fibers? I think not.

For your sake, I hope you are never accused of a crime and judged by a juror such as yourself. You have never given the notion of innocence a chance and I doubt you ever will.

Haven't you seen enough stories in recent years about people being wrongly convicted? Doesn't that cause you to have a careful and discerning eye when it comes to the prosecution and all its work?

It would be different if this was a slam dunk guilt situation, but it's not. That's when the scrutiny should kick in at full force.

United States v. Agurs, 427 U.S., at 112.

I plan to put this useful and necessary cite into my brain attic and remembered forever. Thanks.

When Feldman brought up the 16 Feb phone call today he started to summarize the content. Dusek quickly interrupted and said specifics were not necessary. Mudd agreed. Dusek does not want the gist of that call known.

Not so. I take the evidence seriously, with a careful and discerning eye. It is compelling, imo. I think at this point in the trial, a few days into the defense case, it is fair to have the opinion that the defense is not successfully refuting the forensic evidence put up by the prosecution.

I'm sitting here listening to my radio. The current song is Humble Pie's 30 Days in the Hole. Is it applicable?

This is not a juror we're talking about here. It is the father of the murder victim.

A father that had a daugher disappear.

Who lied to police while they were searching for his daughter.

She could have been somewhere, being tortured, raped, starving to death, dying of thirst and starvation.

AND HE CONTINUED TO LIE. HIM, HIS WIFE, and ALL THEIR FRIENDS, except ONE. THE BARB. She told the truth to the police. At least the part she knew about. Because she was still so drunk the next morning she just spewed what she knew to the cops.

SO, HIS DAUGHTER is lying somewhere in PAIN, and HE, HIS WIFE, AND FRIENDS LIE. His WIFE goes on a shopping spree, gets on TV shows, is worried about her HAIR, her BREASTS, and we are supposed to think HE CARES ABOUT his DAUGHTER!

(please correct me if any of the above statements are not 100% the truth)

Is it animated?

Morphed, I think. They look like Bart & Lisa Simpson.

I'd sure like to know the specifics of this phone call. Does the jury know? Starting to look more and more
like someone else dumped the body around th 16th.

Think about this. PENDERGAST Put HARRY TRUMAN in office. (Vice President of the US). Roosevelt died (the President) and TRUMAN took over as PRESIDENT. TRUMAN is the one that DROPPED THE ATOM BOMB. Remember him now?

Jury definitely does not know. Based on previous rulings from Judge Mudd, they may never know.

This sort of thing has bothered me about this case all along. How can justice be served if all the truth is not known?

"Westerfield fibers found on Danielle's body."

I don't know why you would hold the fiber evidence in any higher regard than the bug evidence. Do you know about the micrspectrophotometer? I know it is an advanced fiber testing method that can be used to further compare fibers after all other tests show similarity. Did you know that there were some fibers in this case that appeared similar in all ways tested before being sent to the microspectrophotometer - the criminalist thought they were they same - till the were examined with the microspectrophotometer and found not to be the same - ruled out. I will accept nothing less than this test on the fibers for this reason. As far as I know - only the orange fiber we have been discussing has been examined by the advanced method and still found to be similar - the others - especially all these blue/gray fibers we talk about - were not sent.

it is fair to have the opinion that the defense is not successfully refuting the forensic evidence put up by the prosecution.

That is because the Prosecution's forensic evidence took weeks to get into , but amounts to only a few seconds worth of time. The defense has plenty of time to discount it, it will only take about 30 minutes to do so.

All the other evidence they had, witnesses, cadaver dogs, statements taken by police, have been totally and successfully refuted.

MOst of the PROSECUTION witnesses have stated that the policed misconstrued their statements. The forensics investigators, when asked did they ID other unknown samples of hair/prints/fibers, said NO, WHen asked WHY, they said, WE WERE TOLD ONLY TO DO THE ONES THAT MATCHED DW.
