Yes he can. He can be impeached and convicted because the Congress wants it. They are the judge and jury, and there is no appeal. And your nemises is right. If something ugly enough comes out as to one's past, Congress should bounce the perp. If Benedict Arnold had been elected president not having been outed earlier, and while president, it was found out that he did what he did, he most certainly would have been removed. But obviously, when something was done, and what it was, is relevant. In the end it is entirely a prudential matter for Congress to determine, and that is the way it should be.

I understand that an out of control Congress could do whatever it wanted to, but you just cannot be impeached for something that happened years before you were elected.
