The State and the USA have an interest in making sure that no one is taken from the USA and put into some foreign culture, I don't care if he is only 3 days old, if he is of US descent and heritage.
Despite your claim that this is different from the Elian case, you sound exactly like Uncle Fidel explaining why Elian should be in Cuba. I assume if this mother had converted to Judaism you would empower the State and USA to take away her child so she couldn't travel with him to Israel?
