SAN DIEGO -- A computer expert hired by David Westerfield's defense team said that at least some of the pornography seized from his home was downloaded by the defendant's son.

Marcus Lawson (pictured, right), president of Global CompuSearch of Spokane, Wash., testified Wednesday that he found two photographs of naked women and Japanese "anime" computer animations on the hard drive of a Gateway computer in an upstairs bedroom used by Westerfield's 18-year-old son, David Neal Westerfield. The former Customs Service agent said that a detailed analysis of the files showed the pornography was downloaded at about the same time someone was accessing an email account belonging to the younger Westerfield.

David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.

David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.

Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.

Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.

"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.

A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."

Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.

Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.

"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.

"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.

Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.

That bugs me big time!

They were not looking for evidence to find the killer of Danielle..they were looking only for evidence to tie it to DW.

Shame on them and heaven help us all.

You're right. I thought that was interesting when a Le gave DW the name of Feldman. That there was another nail added to the "being Set Up" scenario. The first time I saw the VD(s) on TV, I told my husband this smells to high heaven. Something is not right with those two and then when the LE came out and said they were not suspects, I just sat there in shock. I looked at my husband and said they must must know something on someone high up because there is no way either of these two could not be considered a suspect.

1) Dr. Norman Sperber, a forensic dentist, testifies that he identified Danielle's body through dental records. He notes that four of Danielle's upper front teeth were missing and only one of them was found on or near her body. He testifies that it is "not uncommon" for teeth to come loose in decaying bodies, though animals usually don't carry them off. There are no signs of trauma to the mouth, though a relatively soft impact could have knocked the teeth loose.
2) Damon van Dam, Danielle's father, testifies about the events surrounding his daughter's disappearance. Lead defense attorney Steven Feldman cross-examines him about his sexual activities.
3) Dr. Brian Blackbourne, the county's chief medical officer, , testifies that no cause of death could be established because Danielle's body was so badly decomposed and ravaged by animals. Gunshot, blunt trauma, poisoning, stabbing and strangulation have all been ruled out as causes of death. It was, however, possible that she died by suffocation.

They started the case with no body and no serious investigation of the swingers club, expecting that things would just fall in place as new evidence developed, It didn't.

I would how many basically good people on the prosecution team and in LE now realize in their hearts, that they have to wrong person?

You are right. Most likely, Rick Roberts is being used by LE at this point in time. Another person purportedly connected to LE posts on one of the boards on the internet--seems to have found a way around the gag order--and most of it appears to be spin. A lot of what he predicted didn't pan out. I think the DA's office uses people when it suits them.

me thinks you're right. I am in the group that is 90% sure the blood, fiber, child porn and strange behaviour evidence is strong enough to convict.. but I know for a fact that feldman still has time to completely change the entire scenario..although one would think he would have been able to explain how the blood got on his motor home and jacket, and the exchange of fibers etc by now.. I'm still waiting for feldman to explain all of it..

The first time I saw the VD(s) on TV, I told my husband this smells to high heaven.

Same here. The things they said and their manner, tone of voice, everything sounded so fake to me.

I'll never forget Brenda saying, "Our family feels incomplete." That was one of the lamest things I've ever heard anybody say. You would have thought they were talking about a missing family pet instead of their own child!!

Probably quite a few....when did they realize it tho?....when they found the shell casing but then never put anything regarding guns on the search warrant?..when they found the indentified prints in the VD home?..when only certain evidence was sent in for testing?..when they didn't send the brown hairs in for offender database testing?? on and on...when they realized that Hey, he wasn't really sweating, lets just say he was...hey, he didn't give us that Garry's number....oh yeah, he did...lets wait till the trial and the defense brings it up.

It also bothered me when asked if they (VD(s) were asking themselves if they could have done things differently that night, their response, no. "NO", any parent who has lost a child, would be saying over & over, what if we had done this or done that. I could not believe they said NO......That in itself said alot!!!

Re: clothing on or not on Danielle, at first when Brenda (or m-i-l) held up what Danielle was last wearing, it was explained as an identical set borrowed from a neighbor. Later, Brenda said she bought two sets of these jammies with the cascading flowers so Danielle and her spend-the-night guests could dress the same when Danielle had sleepovers.

I could understand a vague, "Uh, I don't remember where we got them or when," but a very detailed description of their origin and their purpose seems, again, like way too much detail.

They're good at that, though, aren't they? Putting all the little fine points on things? Maybe it'll seem more believable that way.

If it were me: "Uh, I think they came around 6:00-ish, but I'm not sure."

I really don't want to read this whole thread, but did anyone point out the question that if it were the son's porn, why wouldn't the defense just put the son on the stand and have him say that it was he who downloaded it. Wouldn't that save time? I know, that would be too easy and might mean that the son would have to perjur himself.

She is not a hair examiner...only goes by what info she is given...if they say blonde hair..she assumes blonde..no idea on lenghth of hair.

When doing mito testing..cannont determine if the hair has been bleached or color treated.
