Defense Hopes To Show Child Porn Wasn't Downloaded By Defendant

POSTED: 12:15 p.m. PDT July 3, 2002
UPDATED: 2:55 p.m. PDT July 3, 2002

SAN DIEGO -- A computer expert hired by David Westerfield's defense team said that at least some of the pornography seized from his home was downloaded by the defendant's son.
Marcus Lawson, defense computer expert
Marcus Lawson (pictured, right), president of Global CompuSearch of Spokane, Wash., testified Wednesday that he found two photographs of naked women and Japanese "anime" computer animations on the hard drive of a Gateway computer in an upstairs bedroom used by Westerfield's 18-year-old son, David Neal Westerfield. The former Customs Service agent said that a detailed analysis of the files showed the pornography was downloaded at about the same time someone was accessing an email account belonging to the younger Westerfield.

David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.

David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.

Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.

Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.

"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.

A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."

Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.

Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.

"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.

"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.

Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.

Wonder if the police checked any of the miscellaneous unidentified prints, DNA, hair or fibers found in the VD house and in/around Danielle's body against this guy.

That would be great!! This stuff is interesting, important and people (some call them sheeple) need to be aware of all of it. But society, media, govt sure doesn't try to encourage it...few groups do..pro-2nd amend org are amongst the few that do promote awareness and self-education.

Ah, but Kim, you took the media's spin on this case and ran with it from the very first. Don't deny it--I'll just pull out your posts and post them if you do--everything from the 68,000 porn images to the motorhome being bleached so badly the dogs wouldn't enter, and on and on. And you quote from Court TV as though it were evidence or testimony--have done so many times. You may not see this in yourself, but you are perhaps one of the most vulnerable to the media spin of anyone I've ever known.

Would the fabric seats in a vehicle be more likely to be acrylic, polyester, nylon or rayon?

I have been off my computer for several days, so need to get caught up. I was l3 years in the legal field, and I can assure you that BOTH sides pull dirty tricks. Then variables spread to the presiding judge over the case, coupled with untruthful testimony, and the most tenuous aspect is the jury.

My guess is Polyolefin/Polypropylene(OLEFI N)also known as Herculon. Rayon is sensitve to mildew and silverfish and sun fading and is more likely to be used in indoor home furnishings than in cars/boats/RV's

A lot of defense lawyers are sneaky, dishonest jerks, and they try to trick police on the stand - and take obvious pleasure in it. It's one thing to ask questions in an attempt to get at the truth of the facts and the investigation, and another thing to try to confuse and befuddle an honest man. I'd rather have pond scum in my house than have some of them in my yard.

Oh, I agree. There are good reasons why some lawyers are despised.

That's a puzzling piece. Didn't another 'finder' say that he recognize her by her blue eyes? How freaky is that? Are those two witnesses(or is it the same one?) subject to recall???

This might suggest that Danielle was, indeed, 'planted' to be found at a time of *someone's* choosing. But whose?

Did Damon stash the body somewhere until they had a good, solid, 'murderer' established? Did he need to have the body found so that he could claim an insurance policy?

Did Feldman cross examinate the witness/es closely? Or did he buy their story at face value?

Did the 'finders' have contact with Damon or Brenda during the search for Danielle, or the other search that IIRC, Brenda helped with?

Sorry I don't have answers, just so many questions......

I thought I had heard one of the searchers testify to that and posted it on one of the threads, but have not been able to find it in any of the transcripts. I'm afraid I may have imagined it. Hope I didn't mislead anyone.

I seem to recall hearing it on CTV and commenting, "Boy, is that a ridiculous statement, her eyes would be long gone, even if animal hadn't gotten to her."

The statement about recognizing her from her gaps between her teeth was ridiculous, too, but I don't remember any questioning about that, either, during the trial.

It's amazing to see the holes in the testimony. Just what DID the SDPD think they had on him at the time of arrest, and I don't mean that as a rhetorical question. :-)

An unrolled hose and the word, bleach, on a shopping list are not grounds for a murder trial with the penalty of death. I wouldn't be surprised if some ethical cop slipped Feldman's name to him out of disgust!

Don't suppose it would have been the "X" of one of BVD friends do you?
