Maybe Garza. I don't think it will be Luttig. But, I definitely don't think it will be Posner, Easterbrook, or Richard Epstein.

Garza's kinda old, isn't he? But I agree he'd be a good one. A lot of the "inside baseball" legal folks think the firts Sp.Ct. appointment will come from the 5th Circuit.

As to whom the retiree will be, I think it could be Stevens, Sandy, or Renquist.

I think it will be O'Connor. She has speculated over the past couple years that she wants to retire.
